                             SUMMARY
 
The following summary is not prepared by the sponsors of the

consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Contingent on interstate agreement, directs State Board of
Higher Education and Oregon Health and Science University Board
of Directors to consider Washington residents to be residents of
Oregon for purposes of determining fees and tuition.
 
                        A BILL FOR AN ACT
Relating to higher education tuition rates; amending ORS 351.647.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 351.647 is amended to read:
  351.647.  { + (1) + } The Legislative Assembly finds that:
    { - (1) - }  { +  (a) + } It is in the interest of this state
and its people that Oregon residents have access to the
post-secondary institutions in the Northwest which best provide
for the educational needs of those students;
    { - (2) - }  { +  (b) + } The people of Oregon and their
post-secondary institutions benefit through the provision of
access to Oregon colleges and universities for students from the
state of Washington and from the enhanced economic and cultural
well-being of the northwest region; { +  and + }
    { - (3) - }  { +  (c) + } The state should reduce or
eliminate the nonresident tuition barriers which might exist
between the states of Oregon and Washington to restrict or
inhibit enrollment of residents of one of these states in a
community college or public college or university in the other
state  { - ; - }  { + . + }
    { - (4) The general policy statement on reduction of
admission and tuition barriers between the states of Oregon and
Washington shall not apply to students at the Oregon Health and
Science University, where enrollment priority shall continue to
be given to qualified Oregon residents; and - }
    { - (5) - }  { +  (2)(a) + } The State Board of Higher
Education   { - and the State Board of Education shall develop
plans to carry out the intent of this policy within the
appropriations available, and shall report to the appropriate
legislative review agency before implementing the plan - }  { +
and the Oregon Health and Science University Board of Directors
shall jointly enter into an interstate agreement with the State
of Washington to allow Oregon residents to be considered
residents of Washington for purposes of determining fees and
tuition to be paid by Oregon residents while attending any public
post-secondary institution in Washington. Any interstate
agreement entered into under this paragraph shall be in
accordance with ORS 190.410 to 190.440.
  (b) If the State of Washington agrees to the provisions of this
subsection, the State Board of Higher Education and the Oregon
Health and Science University Board of Directors shall consider
Washington residents to be residents of Oregon for purposes of
determining fees and tuition to be paid by Washington residents
while attending any state institution of higher education within
the Oregon University System or at the Oregon Health and Science
University + }.
