  On page 1 of the printed bill, line 2, after 'Century ' delete
the rest of the line and line 3 and insert a period.
  Delete lines 5 through 31 and delete pages 2 and 3 and insert:
  '  { +  SECTION 1. + }  { + Section 2 of this 2003 Act is added
to and made a part of ORS chapter 329. + }
  '  { +  SECTION 2. + }  { + (1) Each school district shall
adopt policies and procedures for promoting students to the next
grade level and for retaining students at a grade level. The
policies and procedures shall place a student at a grade level
that is academically, socially and emotionally suited to the
needs of the student.
  ' (2) The teacher of a student who is being considered for a
promotion to another grade that is more than one grade higher
than the current grade of the student, a promotion to another
grade prior to the end of the school year or retention at a grade
level must:
  ' (a) Notify the principal of the school the student attends;
  ' (b) Make a recommendation to the principal concerning the
student's promotion to another grade level or the student's
retention at a grade level; and
  ' (c) Hold a conference with the parent of the student to
discuss the recommendation.
  ' (3) The parent of the student shall make the final decision
of whether to promote the student to another grade level or
retain the student at the grade level. If the decision of the
parent does not agree with the recommendation of the student's
teacher or the principal, the parent must sign a form that
releases the school district from responsibility for the
promotion or retention of the student. The school district shall
place the form in the student's file.
  ' (4) Each school district shall determine the contents of the
form required by subsection (3) of this section as part of the
policies and procedures adopted under this section. + }
  '  { +  SECTION 3. + }  { + Section 2 of this 2003 Act first
applies to the 2004-2005 school year. + } ' .
