SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Specifies that applicant for license as public accountant does
not have to receive passing grade in any section of examination
for certificate of certified public accountant related to
business law.
Provides that public accountants first licensed after January
1, 2002, may not perform audits.
A BILL FOR AN ACT
Relating to public accountants; creating new provisions; and
amending ORS 673.100 and 673.103.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 673.100 is amended to read:
673.100. (1) The Oregon Board of Accountancy shall issue a
license as a public accountant to a person who applies for the
license and who:
(a) Passes an examination on the code of professional ethics
adopted by the board;
(b) Meets the requirements of ORS 673.050 for admission to the
examination for the certificate of certified public accountant;
(c) Takes the examination for the certificate of certified
public accountant pursuant to ORS 673.060 and receives a passing
grade in those sections of the examination, excluding the
auditing section { + and any section on business law that the
board by rule specifies as part of the examination + }, that the
board by rule requires an applicant for a license as a public
accountant to pass; and
(d) Has one year of public accountancy experience or the
equivalent satisfactory to the board.
(2) An applicant for a license as a public accountant must make
application on a form provided by the board. The board shall
charge each applicant a fee for application in an amount
determined by the board by rule.
SECTION 2. ORS 673.103 is amended to read:
673.103. A public accountant { + first + } licensed under ORS
673.100 { + after January 1, 2002, + } may not perform audits.
SECTION 3. { + (1) The amendments to ORS 673.100 by section 1
of this 2003 Act apply to the examinations for the certificate of
certified public accountant taken on or after the effective date
of this 2003 Act.
(2) The amendments to ORS 673.103 by section 2 of this 2003
Act:
(a) Do not relieve a person of any obligation with respect to a
civil penalty or other liability, duty or obligation accruing
under ORS 673.103, 673.170 or 673.400; and
(b) Do not affect an act done or proceeding begun, a liability
incurred or a right accruing, accrued or acquired before the
effective date of this 2003 Act, under the law then in effect. A
proceeding begun before the effective date of this 2003 Act in
accordance with the law then in effect may be completed after the
effective date of this 2003 Act as if this 2003 Act had not been
enacted. + }
