                             SUMMARY
 
The following summary is not prepared by the sponsors of the

consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
 
  Directs Legislative Administration Committee to apply for grant
from Cultural Development Grant Program for constructing and
installing skylights over State Capitol stairwells { +  and
polishing brass railings in State Capitol stairwells + }.
   { +  Expands definition of cultural organization to include
agency of legislative department that maintains property that is
important to state culture or heritage. + }
  Declares emergency, effective July 1, 2003.
 
                        A BILL FOR AN ACT
Relating to improvements to the State Capitol; creating new
  provisions; amending ORS 359.400; appropriating money; and
  declaring an emergency.
  Whereas the installation of skylights over the stairwells in
the old part of the State Capitol would help revive the original
beauty of the building; and
  Whereas the brass in the stairwells of the old Capitol has not
been polished or maintained for 30 years; and
  Whereas polishing the stairwell brass should be the first task
in Capitol restoration after the installation of skylights over
the stairwells; and
  Whereas this time of fiscal austerity limits public resources
for Capitol restoration; and
  Whereas the members of the Legislative Assembly, the Oregon
State Capitol Foundation and the Capitol Club should take it upon
themselves to obtain resources to restore the Capitol, including
polishing the brass in the stairwells of the old Capitol; and
  Whereas the state should make a start toward restoring the
State Capitol; now, therefore,
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) The Legislative Administration Committee
shall apply to the Cultural Development Grant Program for a grant
in the amount of $57,750 for plans, construction, repairs and
restoration related to equipping the State Capitol with skylights
over the stairwells and polishing the brass railings in the State
Capitol stairwells.
 
 
  (2) Funds received from the program are continuously
appropriated to the committee for the purposes set forth in
subsection (1) of this section. + }
  SECTION 2.  { + Plans required by section 1 of this 2003 Act
must be acceptable to the Oregon State Capitol Foundation. + }
  SECTION 3.  { + Except for planning, the Legislative
Administration Committee may not begin the project required by
section 1 of this 2003 Act or allow a contract to be let for the
project without first reporting to the Emergency Board. + }
  SECTION 4. ORS 359.400 is amended to read:
  359.400. As used in ORS 359.400 to 359.444:
  (1) 'Community Cultural Participation Grant Program' means the
program created by ORS 359.436.
  (2) 'Core partner agencies' means the Oregon Arts Commission,
the Oregon Council for the Humanities, the Oregon Heritage
Commission, the Oregon Historical Society and the State Historic
Preservation Officer.
  (3) 'Cultural Development Grant Program' means the program
created by ORS 359.431.
  (4) 'Cultural organization' means { + : + }
   { +  (a)  + }An entity that is:
    { - (a) - }   { + (A)  + }Exempt from federal income tax
under section 501(c)(3) of the Internal Revenue Code; and
    { - (b) - }   { + (B)  + }Organized primarily for the purpose
of producing, promoting or presenting the arts, heritage,
programs and humanities to the public or organized primarily for
identifying, documenting, interpreting and preserving cultural
resources { + ; or
  (b) An agency of the legislative department, as defined in ORS
174.114, that maintains property that is of importance to the
culture or heritage of the state + }.
  (5) 'Trust for Cultural Development Account' means the account
established by ORS 359.405.
  SECTION 5.  { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect July 1,
2003. + }
