A BILL FOR AN ACT
Relating to parental abductions; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) There is created the Task Force on Parental
Abductions consisting of 10 members appointed as follows:
(a) The President of the Senate shall appoint the following
five members:
(A) One member from among members of the Senate;
(B) One member who is a judge serving in a family court
department;
(C) One member who is a district attorney;
(D) One member who is an employee of the Division of Child
Support of the Department of Justice; and
(E) One member who is a parent and has experienced the
abduction of a child by the other parent.
(b) The Speaker of the House of Representatives shall appoint
the following five members:
(A) One member from among members of the House of
Representatives;
(B) One member who is an attorney licensed in this state and
has extensive experience in domestic relations matters;
(C) One member who is an employee of a law enforcement agency;
(D) One member who is an employee of the Department of Human
Services and has expertise in issues affecting children; and
(E) One member representing a domestic violence program
established in this state.
(2) The purpose of the task force is to study and evaluate
strategies to reduce the incidence of parental abductions in this
state and to find methods to resolve parental abductions in a
manner that serves the best interests of the child and the
child's family.
(3) The task force shall study:
(a) The extent of emotional problems caused by parental
abductions, including parental alienation, post-traumatic stress
disorder, grief and depression.
(b) The financial and emotional impact of parental abductions
on abducted children, their families and their schools.
(c) The actual incidence of parental abductions in this state,
including children abducted and taken from this state and
children abducted and brought to this state.
(d) Barriers to the recognition of the problem of parental
abductions and strategies to remove the barriers to increase
public awareness of the problem.
(e) Methods to resolve parental abductions successfully.
(4) The task force shall develop legislation based on the
findings of its studies. The task force may presession file
legislation in the manner provided in ORS 171.130 for interim
committees. All legislation recommended by official action of the
task force must indicate that it is introduced at the request of
the task force.
(5) The task force shall use the services of permanent
legislative staff to the greatest extent practicable.
(6) All agencies of state government, as defined in ORS
174.111, are directed to assist the task force in the performance
of its duties and, to the extent permitted by laws relating to
confidentiality, to furnish such information and advice as the
members of the task force consider necessary to perform their
duties.
(7) A majority of the members of the task force constitutes a
quorum for the transaction of business.
(8) Official action by the task force requires the approval of
a majority of the members of the task force.
(9) The task force shall elect one of its members to serve as
chairperson.
(10) The task force shall meet at the times and places
determined by its chairperson.
(11) The task force shall report its findings and
recommendations for reducing parental abductions to the
Seventy-third Legislative Assembly in the manner provided by ORS
192.245 no later than January 31, 2005.
(12) Notwithstanding ORS 171.072, members of the task force who
are members of the Legislative Assembly are not entitled to
mileage expenses or per diem expenses and serve as volunteers on
the task force. All other members of the task force are not
entitled to compensation or reimbursement for expenses and serve
as volunteers on the task force. + }
SECTION 2. { + Section 1 of this 2003 Act is repealed on
February 1, 2005. + }
SECTION 3. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
