Establishes Buy Oregon Policy Council. Makes legislative

establishing public agency purchase preference program for
Oregon-grown agricultural products.
Sunsets January 2, 2018.

A BILL FOR AN ACT
Relating to state purchasing preferences; appropriating money;
and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + The Legislative Assembly hereby finds and
declares that:
(1) An economically and environmentally thriving rural Oregon
is vitally important to all Oregonians.
(2) Increasing institutional, organizational and individual
consumer support for Oregon agriculture furthers the state's
economic and environmental goals.
(3) Oregon farmers and ranchers produce some of the safest and
highest quality agricultural products in the world, working
within a regulatory environment that promotes environmental
stewardship. However, Oregon consumers and institutions often buy
cheaper products from elsewhere.
(4) Oregon's agricultural production system, which is designed
to produce a safe, affordable, nutritious and adequate supply of
food and other agricultural products, must also balance economic,
environmental and social considerations that are important to the
people of this state.
(5) Reducing the environmental and fiscal costs of the
transportation of agricultural products is both desirable and
beneficial to the people of Oregon. + }
SECTION 2. { + (1) The goals of a public agency purchase
preference program for Oregon-grown agricultural products are:
(a) To expand markets for Oregon-grown agricultural products;
(b) To recognize, encourage and reward Oregon farmers and
ranchers;
(c) To reduce unnecessary use of fuel and energy;
(d) To educate Oregonians about where their food and other
agricultural products come from and the costs associated with
transporting, processing and otherwise preparing those products
for consumption or use;
(e) To strengthen ties between urban and rural Oregonians;
(f) To increase the agricultural safety and agricultural
security of all Oregonians; and
(g) To enhance Oregon's rural communities and rural landscapes.
(2) By December 31, 2004, the Oregon Department of
Administrative Services shall adopt rules establishing a public
agency purchase preference program for Oregon-grown agricultural
products. The rules shall be based on recommendations produced by
the 'Buy Oregon' Policy Council, and shall become effective on
January 1, 2005.
(3) No later than January 1, 2006, the State of Oregon shall
implement a public agency purchase preference program to increase
the amount of Oregon-grown agricultural products purchased by
state institutions. + }
SECTION 3. { + (1) There is established a 'Buy Oregon' Policy
Council consisting of 23 members appointed by the Governor.
(2) The following council members shall be recruited from the
private sector and nongovernmental organizations:
(a) Two members who are Oregon agricultural producers;
(b) One member who is an Oregon agricultural processor;
(c) One member who is an Oregon agricultural distributor;
(d) One member who is an Oregon agricultural retailer;
(e) One member who represents the Oregon public health
community;
(f) One member with expertise in agricultural policy and legal
issues;
(g) One member with expertise in food security issues;
(h) One member with expertise in direct marketing of
agricultural products;
(i) One member from the environmental community;
(j) One member with expertise in Oregon land use or farmland
protection issues; and
(k) One member of the public representing Oregon consumers.
(3) The following council members shall be recruited from
public bodies:
(a) One member from the State Department of Agriculture;
(b) One member from the State Forestry Department;
(c) Two members from Oregon State University, including one
from the Oregon State University Extension Service and one from
the Oregon State University College of Agricultural Sciences;
(d) One member from the Oregon Department of Administrative
Services;
(e) One member from the Department of Transportation;
(f) One member from the Department of Education;
(g) One member from the Department of Land Conservation and
Development;
(h) One member from the Department of Human Services;
(i) One member from the Economic and Community Development
Department; and
(j) One member from the State Board of Agriculture.
(4) The term of office of each member is four years, but a
member serves at the pleasure of the Governor. Before the
expiration of the term of a member, the Governor shall appoint a
successor whose term begins on July 1 next following. A member is
eligible for reappointment. If there is a vacancy for any cause,
the Governor shall make an appointment to become immediately
effective for the unexpired term.
(5) The purposes of the 'Buy Oregon' Policy Council are to
promote and support a thriving agricultural economy, while
increasing opportunities for improving environmental stewardship
and for improving communication and cooperation between Oregon's
urban and rural communities. Whenever possible, the council shall
work collaboratively with existing organizations and agencies to
further the purposes of the council.
(6) The council shall develop a public agency purchase
preference program for Oregon-grown agricultural products
according to the following timeline:
(a) By June 30, 2004, the council shall develop a framework for
a public agency purchase preference program for Oregon-grown
agricultural products including:
(A) Determining the most effective and efficient form of public
agency purchase preference for achieving the goals of the public
agency purchase preference program; and
(B) Establishing strategies, methods, agency reporting
requirements and timelines for implementing the public agency
purchase preference program, including but not limited to:
(i) Defining 'Oregon-grown agricultural products'; and
(ii) Determining how to most effectively and efficiently
document Oregon-grown agricultural products in the marketplace;
(b) By December 31, 2004, the council shall oversee the
production and distribution of support materials for the
implementation of the public agency purchase preference program;
(c) By June 30, 2005, the council shall develop criteria for
evaluating the effectiveness of the public agency purchase
preference program in achieving the goals described in section 2
of this 2003 Act;
(d) By January 1, 2010, the council shall evaluate the
effectiveness of the public agency purchase preference program
and adjust aspects of the program as appropriate to more
effectively achieve the goals described in section 2 of this 2003
Act; and
(e) By January 1, 2015, the council shall evaluate the
effectiveness of the public agency purchase preference program
and produce a report detailing its findings by September 30,
2016.
(7) The council shall:
(a) Review incentives and barriers facing agricultural
producers interested in achieving organic or sustainable
certifications in Oregon and recommend policies for increasing
the ability of agricultural producers who so desire to achieve
organic or sustainable certification;
(b) Educate Oregonians about their agricultural system,
including increasing their awareness of:
(A) Where their food and other agricultural products come from;
(B) How their food and other agricultural products are produced
and the costs associated with transporting, processing and
otherwise preparing those products for consumption or use;
(C) How their decisions about purchases of food and other
agricultural products can support Oregon agriculture and rural
Oregon communities; and
(D) How successful farming, high-quality agricultural products
and a healthy environment are related;
(c) Support and promote state and local efforts to help Oregon
agricultural producers to develop niche marketing and value-added
opportunities;
(d) Strengthen relationships between Oregon markets and Oregon
agricultural producers by promoting local preferences for
Oregon-grown agricultural products at the institutional,
organizational, business and individual levels;
(e) Encourage partnerships between public and private bodies to
help Oregon agricultural producers develop new investment options
that increase value-added opportunities or develop new
alternative natural resources enterprises;
(f) Promote and encourage educational and research programs
that help agricultural producers focus more on products, markets
and profits and less on bulk production; and
(g) Prepare and submit a biennial report to the Legislative
Assembly that includes a summary of the council's work and an
assessment of the state's baseline agricultural production
output. The assessment shall include data on:
(A) The amount of agricultural products produced annually in
this state;
(B) The amount of agricultural products that is purchased and
consumed by state residents;
(C) The dollar amounts and total volume of purchases by state
institutions of categories of agricultural products for which an
Oregon-grown agricultural product is available, and the
percentages of the dollar amounts and the total volume of
purchases that are Oregon-grown agricultural products; and
(D) The extent to which agricultural products produced in
Oregon are processed, distributed, marketed and purchased by
local individuals and businesses.
(8) The council shall meet at times and places specified by the
call of the chairperson or of a majority of the members of the
council.
(9) A majority of the members of the council constitutes a
quorum for the transaction of business.
(10) Official action by the council requires the approval of a
majority of the members of the council.
(11) The council shall elect one of its members to serve as
chairperson.
(12) Members of the council are entitled to compensation and
expenses in the manner and amounts provided for in ORS 292.495.
Claims for compensation and expenses incurred in performing
functions of the council shall be paid out of funds appropriated
to Oregon State University for that purpose.
(13) The Institute for Natural Resources at Oregon State
University shall provide staff support to the council.
(14) All agencies of state government, as defined in ORS
174.111, are directed to assist the council in the performance of
its duties and, to the extent permitted by laws relating to
confidentiality, to furnish such information and advice as the
members of the council consider necessary to perform their
duties.
(15) Except as otherwise provided in this section, the council
is subject to the provisions of ORS 171.605 to 171.635 and has
the authority contained in ORS 171.505 and 171.510.
(16) The council may presession file legislation in the manner
provided in ORS 171.130 for interim committees. All legislation
recommended by official action of the council must indicate that
it is introduced at the request of the council. + }
SECTION 4. { + (1) Oregon State University may accept
contributions of funds and assistance from the United States
Government or its agencies or from any other source, public or
private, and agree to conditions placed on the funds not
inconsistent with the purposes of sections 1 to 3 of this 2003
Act.
(2) All funds received by Oregon State University under this
section shall be paid into the State Treasury and deposited in
the General Fund to the credit of Oregon State University. The
funds are appropriated continuously to Oregon State University
for the purposes of carrying out the provisions of sections 1 to
3 of this 2003 Act. + }
SECTION 5. { + (1) Notwithstanding the term of office
specified by section 3 of this 2003 Act, of the members first
appointed to the 'Buy Oregon' Policy Council under section 3 of
this 2003 Act:
(a) Five shall serve for a term ending December 31, 2004;
(b) Six shall serve for a term ending December 31, 2005;
(c) Six shall serve for a term ending December 31, 2006; and
(d) Six shall serve for a term ending December 31, 2007.
(2) Of the members first appointed to the council, the term of
office shall begin on or after January 1, 2004. + }
SECTION 6. { + Sections 1 to 5 of this 2003 Act are repealed
on January 2, 2018. + }
SECTION 7. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
