A BILL FOR AN ACT
Relating to federal forest programs; creating new provisions;
amending ORS 526.065; limiting expenditures; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon: + }
SECTION 1. { + (1) Pursuant to the authority established in
ORS 526.065, the State Forestry Department may apply for, accept
and utilize grants from the federal government for forest legacy
programs.
(2) If the department receives a grant from the federal
government for forest legacy programs, the moneys shall be paid
into the State Treasury and credited to the State Forest
Enhancement Donation Subaccount. + }
SECTION 2. { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section ___, chapter ___, Oregon Laws 2003 (Enrolled ___ Bill
___), for the biennium beginning July 1, 2003, as the maximum
limit for payment of expenses from federal funds, collected or
received by the State Forestry Department, is increased by
$1,055,000 for the purposes of carrying out the implementation of
a federal forest legacy program in the state. + }
SECTION 3. { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section ___, chapter ___, Oregon Laws 2003 (Enrolled ___ Bill
___), for the biennium beginning July 1, 2003, as the maximum
limit for payment of expenses from federal funds, collected or
received by the State Forestry Department, is increased by
$30,000 for the purposes of administering a federal forest legacy
program in the state. + }
SECTION 4. ORS 526.065 is amended to read:
526.065. (1) The State Forestry Department may receive gifts,
grants, bequests, endowments and donations of moneys, labor or
materials from public and private sources for the purpose of
contributing to the management and enhancement of state forests,
including but not limited to activities such as recreation,
education, interpretation, research and monitoring, cultural
resources management and habitat improvement.
{ + (2) The department may participate in a federal forest
legacy program and apply for, accept and utilize grants from the
federal government to accomplish the goals of the federal forest
legacy program. + }

department shall deposit moneys received under this section into
the State Forest Enhancement Donation Subaccount created under
ORS 526.060. The department may expend moneys, materials or labor
received under this section only for the purposes specified in
the gift, grant, bequest, endowment or donation. If no purpose is
specified, the department may use the moneys, materials or labor
for the management and enhancement of state forests.
SECTION 5. { + Section 1 of this 2003 Act is repealed on
January 2, 2006. + }
SECTION 6. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
