SUMMARY

brief statement of the essential features of the measure.
Redirects moneys in Medicaid Upper Payment Limit Account to
certain rural health care programs { + , to support certain
nursing education programs and certain primary care safety net
health clinics + }.
Declares emergency, effective July 1, 2003.
A BILL FOR AN ACT
Relating to rural health care; amending ORS 440.420; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 440.420 is amended to read:
440.420. (1) The Medicaid Upper Payment Limit Account is
established in the State Treasury separate and distinct from the
General Fund. Moneys in the account are continuously appropriated
to the Oregon Department of Administrative Services for
{ - health-related programs - } { + rural health care. Every
six months, the following shares of the amount transferred under
subsection (2) of this section to the Medicaid Upper Payment
Limit Account during the preceding six months shall be
distributed as follows:
(a) 20.5 percent to the Oregon Rural Health Association for
Rural Health Viability Grants described in section 2, chapter
978, Oregon Laws 2001;
(b) 6.85 percent to the Office of Rural Health for federally
certified rural health clinics;
(c) 11.6 percent to the Oregon Department of Administrative
Services for the Oregon Health and Science University for the
purpose of grants to post-secondary education institutions to
support nursing education programs;
(d) 0.69 percent to the Office of Rural Health for the purpose
of enhancing emergency medical service systems in rural areas as
specified in ORS 442.507;
(e) 0.69 percent to the Area Health Education Center program
established under ORS 353.450; and
(f) 5.67 percent to the Department of Human Services for
primary care safety net health clinics, as defined by the Office
of Rural Health, that are not federally certified rural health
clinics + }.
(2) The Department of Human Services shall transfer to the
Medicaid Upper Payment Limit Account that portion of the payment
received by the department from health districts in this state
under the Proportionate Share Incentive Adjustment State Plan
Amendment to the State Medicaid Plan and under intergovernmental
agreements with the health districts that is attributable to the
federal funds portion of the total payment made by the department
to the health districts during the biennium.
SECTION 2. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect July 1,
2003. + }
