SUMMARY
The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.
Appropriates moneys from General Fund to Department of
Education for State School Fund.
Limits expenditures of lottery funds allocated to department
for State School Fund.
States that certain amounts are considered replacement revenue.
Declares emergency, effective July 1, 2003.
A BILL FOR AN ACT
Relating to education; appropriating money; limiting
expenditures; and declaring an emergency.
Whereas the Legislative Assembly has recognized the importance
of public schools by enacting high standards of academic
achievement; and
Whereas education is a defining feature of a democracy, helping
to create a citizenry capable of self-government and civic
engagement; and
Whereas public schools provide the foundation for economic
success by helping to train a workforce and fostering a positive
business environment; and
Whereas economic recovery and development depend upon a ready
workforce that possesses the skill and education to handle the
jobs of the 21st century; and
Whereas public schools provide opportunity and hope for
children from all segments of society; and
Whereas public schools have been forced to shorten the school
year, increase class sizes and eliminate programs such as
athletics, art, drama and music; and
Whereas we, the people of the State of Oregon, cannot expect to
achieve and maintain prosperity if we shortchange public
education; and
Whereas the sum of $6 billion is required to provide reasonable
class sizes and a full school year, and to fund public education
with any less would be an abrogation of our responsibilities to
our schools, our children and the future of the State of Oregon;
now, therefore,
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of
Education, out of the General Fund, for the fiscal year beginning
July 1, 2003, the amount of $2,888,799,306 for the State School
Fund. + }
SECTION 2. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of
Education, out of the General Fund, for the fiscal year beginning
July 1, 2004, the amount of $2,888,799,306 for the State School
Fund. + }
SECTION 3. { + Notwithstanding any other law limiting
expenditures, the amount of $108,976,681 is established for the
fiscal year beginning July 1, 2003, as the maximum limit for
payment of expenses from lottery moneys allocated from the
Administrative Services Economic Development Fund to the
Department of Education for the State School Fund. + }
SECTION 4. { + Notwithstanding any other law limiting
expenditures, the amount of $113,424,707 is established for the
fiscal year beginning July 1, 2004, as the maximum limit for
payment of expenses from lottery moneys allocated from the
Administrative Services Economic Development Fund to the
Department of Education for the State School Fund. + }
SECTION 5. { + Of the amounts distributed to the public school
system from the State School Fund for the fiscal year beginning
July 1, 2003, pursuant to section 1 of this 2003 Act, an amount
determined by the Department of Revenue to be the amount of
reduction pursuant to ORS 310.228 for school districts and
education service districts is specifically designated as
replacement revenue within the meaning of section 11 (9), Article
XI of the Oregon Constitution. If any additional amounts are
distributed from the State School Fund for the fiscal year
beginning July 1, 2003, these amounts are not replacement revenue
within the meaning of section 11 (9), Article XI of the Oregon
Constitution. + }
SECTION 6. { + Of the amounts distributed to the public school
system from the State School Fund for the fiscal year beginning
July 1, 2004, pursuant to section 2 of this 2003 Act, an amount
determined by the Department of Revenue to be the amount of
reduction pursuant to ORS 310.228 for school districts and
education service districts is specifically designated as
replacement revenue within the meaning of section 11 (9), Article
XI of the Oregon Constitution. If any additional amounts are
distributed from the State School Fund for the fiscal year

SECTION 7. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect July 1,
2003. + }
