AN ACT
Relating to state financial administration; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Notwithstanding ORS 137.300, for the biennium
beginning on July 1, 2003, the Department of Revenue shall
distribute:
(1) 66.35 percent of the moneys in the Criminal Fine and
Assessment Account, reduced by the amount reported by the
Department of Justice to the Department of Revenue under ORS
137.300 (4), to the General Fund to be used for general
governmental expenses; and
(2) 33.65 percent of the moneys in the account to the Criminal
Fine and Assessment Public Safety Fund. + }
SECTION 2. { + The allocation of the Criminal Fine and
Assessment Public Safety Fund made by this 2003 Act supersedes,
replaces and is in lieu of any allocation of such funds in prior
years. + }
SECTION 3. { + There are allocated to the Department of Public
Safety Standards and Training for the biennium beginning July 1,
2003, from the Criminal Fine and Assessment Public Safety Fund
the following amounts for the following purposes: + }

Services and Trauma Systems Program created under ORS

SECTION 5. { + There is allocated to the Department of State
Police for the biennium beginning July 1, 2003, from the Criminal
Fine and Assessment Public Safety Fund + } { + the amount of
$1,115,558 for officer training. + }
SECTION 6. { + There are allocated to the Department of
Justice for the biennium beginning July 1, 2003, from the
Criminal Fine and Assessment Public Safety Fund the following
amounts for the following purposes: + }

SECTION 7. { + After the debt service obligations described in
ORS 137.302 (5) are satisfied, if the remaining moneys in the

Criminal Fine and Assessment Public Safety Fund are insufficient
to pay for the quarterly allocations established under this 2003
Act, these allocations shall be reduced proportionately in
sufficient amounts to accommodate the revenue shortfall. + }
SECTION 8. { + Notwithstanding ORS 137.302, there is allocated
to the Oregon Department of Administrative Services for the
biennium beginning July 1, 2003, from the Criminal Fine and
Assessment Public Safety Fund the amount of $1,400,000 for the
Oregon Poison Center at the Oregon Health and Science
University. + }
SECTION 9. { + Notwithstanding any other law limiting
expenditures, the amount of $1,400,000 is established for the
biennium beginning July 1, 2003, as the maximum limit for the
payment of expenses by the Oregon Department of Administrative
Services from the allocation made by section 8 of this 2003 Act
to the Oregon Poison Center at the Oregon Health and Science
University. + }
SECTION 10. { + If Senate Bill 5525 becomes law,
notwithstanding any other law limiting expenditures, the
limitation on expenditures established by section 2, chapter ___,
Oregon Laws 2003 (Enrolled Senate Bill 5525), for the biennium
beginning July 1, 2003, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of Justice, is
increased by $2,395,571. + }
SECTION 11. { + If House Bill 5030 becomes law,
notwithstanding any other law limiting expenditures, the
limitation on expenditures established by:
(1) Section 2 (2), chapter ___, Oregon Laws 2003 (Enrolled
House Bill 5030), for the biennium beginning July 1, 2003, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, tobacco tax receipts
and Medicare receipts, and including federal funds for indirect
cost recovery, collected or received by the Department of Human
Services, is increased by $744,594.
(2) Section 2 (4), chapter ___, Oregon Laws 2003 (Enrolled
House Bill 5030), for the biennium beginning July 1, 2003, as the
maximum limit for payment of expenses from fees, moneys or other
revenues, including Miscellaneous Receipts, tobacco tax receipts
and Medicare receipts, and including federal funds for indirect
cost recovery, collected or received by the Department of Human
Services, is increased by $350,000. + }
SECTION 12. { + This 2003 Act being necessary for the
immediate preservation of the public peace, health and safety, an
emergency is declared to exist, and this 2003 Act takes effect
July 1, 2003. + }
