A BILL FOR AN ACT
Relating to the financial administration of the Department of
Justice; appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + There is appropriated to the Department of
Justice, for the biennium beginning July 1, 2003, out of the
General Fund, the amount of $10,331,558, to be expended for:
(1) Paying the expenses of the district attorneys, as provided
in section 2 of this 2003 Act;
(2) Special payments to counties for deputy district attorneys,
as provided in section 3 of this 2003 Act; and
(3) Paying the expenses incurred in administering this 2003
Act, as provided in section 4 of this 2003 Act. + }
SECTION 2. { + The Department of Justice, for the biennium
beginning July 1, 2003, may allocate from the appropriation made
by section 1 of this 2003 Act moneys for the payment of expenses
of district attorneys. + }
SECTION 3. { + (1) The Department of Justice, for the biennium
beginning July 1, 2003, may allocate from the appropriation made
by section 1 of this 2003 Act moneys for special payments to
counties for deputy district attorneys actually employed by the
county and whose salaries are not paid entirely by federal funds.
(2) Each county shall certify to the Department of Justice, not
later than the fifth day of the quarter, the number of eligible
deputy district attorneys employed for which compensation is
requested for the quarter. Eligible deputy district attorney
positions for which counties may claim compensation are those
filled by an incumbent on the first day of the quarter, the
salaries for which are not paid entirely from federal funds. A
quarterly installment payment claimed by a county under this
section for an eligible deputy district attorney shall be reduced
by the amount of the salary of that deputy district attorney that
is paid in the quarter from federal funds.
(3) Commencing July 1, 2003, from the allocation made by
subsection (1) of this section, each county shall receive
quarterly the amount of $1,375 per deputy district attorney for
up to the first three deputy district attorneys certified by a
county under subsection (2) of this section. The remainder of the
allocation made by subsection (1) of this section shall be paid
in quarterly installments, in each quarter of the biennium, to
the various counties, in amounts which evenly divide the
remainder of one-eighth of the allocation in direct proportion to
the number of deputy district attorneys certified under
subsection (2) of this section, reduced by the number of deputy
district attorneys compensated by the minimum quarterly payment
under this subsection. + }
SECTION 4. { + The Department of Justice, for the biennium
beginning July 1, 2003, may allocate from the appropriation made
by section 1 of this 2003 Act moneys for the payment of expenses
incurred in administering this 2003 Act. + }
SECTION 5. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect July 1,
2003. + }
