SUMMARY

Appropriates moneys from General Fund to Judicial Department
for biennial expenses.
Limits biennial expenditures from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds, collected or received by department.
Excludes from expenditure limitation expenditures from amounts
waived by jurors or for payment of credit card fees or collection
costs.
Limits biennial expenditures of department from federal funds.
Declares emergency, effective July 1, 2003.
A BILL FOR AN ACT
Relating to the financial administration of the Judicial
Department; creating new provisions; amending sections 1 and 2,
chapter 130, Oregon Laws 2001; appropriating money; limiting
expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + There is appropriated to the Judicial
Department, for the biennium beginning July 1, 2003, out of the
General Fund, the following amounts to be used for payment of
expenses of the Supreme Court, Court of Appeals, Oregon Tax
Court, State Court Administrator and Trial Court Operations: + }

SECTION 2. { + Notwithstanding any other law limiting
expenditures, the amount of $23,587,834 is established for the
biennium beginning July 1, 2003, as the maximum limit for payment
of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Judicial Department. + }
SECTION 3. { + For the biennium beginning July 1, 2003,
expenditures from amounts waived by jurors in accordance with ORS
10.075 (3) and expenditures from the Judicial Department
Collections Account established under ORS 1.204 (2) for payment
of credit card fees or collection costs paid to the Department of
Revenue or private collection agencies are not limited. + }
SECTION 4. { + Notwithstanding any other law limiting
expenditures, the amount of $2,350,733 is established for the
biennium beginning July 1, 2003, as the maximum limit for payment
of expenses from federal funds collected or received by the
Judicial Department. + }
SECTION 5. Section 1, chapter 130, Oregon Laws 2001, is amended
to read:

General Fund, the following amounts to be used for payment of
expenses of the Supreme Court, Court of Appeals, Oregon Tax

SECTION 6. Section 2, chapter 130, Oregon Laws 2001, is amended
to read:
{ + Sec. 2. + } Notwithstanding any other law, there is
appropriated to the Judicial Department, for the biennium
beginning July 1, 2001, out of the General Fund,
{ - $163,837,787 - } { + $165,737,787 + } for payment of
indigent defense fees, to be allotted quarterly by the Judicial
Department in a manner that causes expenditures not to exceed the
appropriation made by this section. Amounts appropriated that are
determined by the department to be in excess of the amounts
needed to pay indigent defense costs may be transferred to the
operating budget of the Judicial Department.
SECTION 7. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect July 1,
2003. + }
