to the Department of Education by section 2, chapter 890, Oregon
Laws 2001, for the fiscal year beginning July 1, 2002, for the
State School Fund is increased by $150,000,000.
  ' (2) The expenditure limitation established for the Department
of Education for the State School Fund, by section 1 (4), chapter
13, Oregon Laws 2002 (third special session), is reduced by
$50,000,000.
  ' (3) The expenditure limitation established for the Department
of Education for the State School Fund, by section 19, chapter 2,
Oregon Laws 2002 (fifth special session), is reduced by

established by section 3, chapter 13, Oregon Laws 2002 (third
special session), for expenditure of moneys transferred from the
Education Stability Fund to the State School Fund for the fiscal
year beginning July 1, 2002, is increased by $112,000,000.
  ' (2) The General Fund appropriation to the Department of
Education by section 2, chapter 890, Oregon Laws 2001, for the
fiscal year beginning July 1, 2002, for the State School Fund is

appropriating or allocating moneys, limiting expenditures or
otherwise adjusting appropriations or expenditure limitations,
and in addition to any action taken by the Emergency Board and by

Fund are changed by the amounts specified for the biennium ending

  '  { +  SECTION 10. + }  { + (1) Section 9 of this 2003 Act
becomes operative only if the economic and revenue forecast for
the remainder of the biennium ending on June 30, 2003, that is
scheduled to be released on May 15, 2003, by the Oregon
Department of Administrative Services is more than $150 million
below the forecast that was released on February 28, 2003. For
purposes of this subsection, the amount of the forecast does not
include any proceeds of bonds issued under chapter ___, Oregon
Laws 2003 (Enrolled Senate Bill 856) and credited to the General
Fund.
  ' (2) If the condition specified in subsection (1) of this
section is met, section 9 of this 2003 Act becomes operative on
June 1, 2003. + }
  '  { +  SECTION 11. + }  { + This 2003 Act being necessary for
the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2003 Act
takes effect on its passage. + } ' .
