Chapter 19 Oregon Laws 2005

 

AN ACT

 

HB 5068

 

Relating to state financial administration; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. Notwithstanding any other provision of law, in addition to the amount appropriated by section 1, chapter 497, Oregon Laws 2003, for the biennium ending June 30, 2005, as modified by Emergency Board action, there is appropriated out of the General Fund to the Department of Revenue, for the biennium ending June 30, 2005, the amount of $8,800,000 for the purpose of administrative expenses.

 

          SECTION 2. Notwithstanding any other provision of law, the General Fund appropriation made to the Department of Revenue by section 2, chapter 497, Oregon Laws 2003, for the biennium ending June 30, 2005, for the purpose of making payments authorized by ORS 307.244 and 310.630 to 310.706 for the elderly rental assistance program, as modified by Emergency Board action, is decreased by $1,100,000.

 

          SECTION 3. Notwithstanding any other provision of law, in addition to the amount appropriated by section 1 (2), chapter 678, Oregon Laws 2003, for the biennium ending June 30, 2005, as modified by Emergency Board action, there is appropriated out of the General Fund to the State Forestry Department, for the biennium ending June 30, 2005, the amount of $1,350,000 for the purpose of purchasing catastrophic fire suppression cost insurance for the 2005 fire season.

 

          SECTION 4. Notwithstanding any other law limiting expenditures of the Oregon Department of Administrative Services for the payment of operating expenses of the department from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2005, the limitation on expenditures established by section 2 (1), chapter 389, Oregon Laws 2003, as modified by Emergency Board action, is decreased by $7,661,605.

 

          SECTION 5. Notwithstanding any other law limiting expenditures, the amount of $7,661,605 is established for the biennium ending June 30, 2005, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Oregon Department of Administrative Services for implementation costs of the computing and networking infrastructure consolidation project.

 

          SECTION 6. Notwithstanding any other law limiting expenditures, the amount of $325,000 is established for the biennium ending June 30, 2005, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Oregon Department of Administrative Services for costs of issuance of certificates of participation for the computing and networking infrastructure consolidation project.

 

          SECTION 7. This 2005 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2005 Act takes effect on its passage.
