Chapter 227 Oregon Laws 2005

Relating to Class II all-terrain vehicles; amending ORS 801.193; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. ORS 801.193 is amended to read:
801.193. “Class II all-terrain vehicle” means any motor vehicle that:
(1) Weighs more than a Class I all-terrain vehicle [and less than 8,000 pounds];
(2) Is designed for or capable of cross-country travel on or immediately over land, water, sand, snow, ice, marsh, swampland or other natural terrain; and
(3) Is actually being operated off a highway.
SECTION 2. This 2005 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2005 Act takes effect on its passage.
