Relating to Common School Fund; amending ORS 327.410 and 327.420; and repealing ORS 327.415.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. ORS 327.410 is amended to read:
327.410. The Department of State Lands shall [apportion] transfer the balance of the Distributable Income Account of the Common School Fund established under ORS 273.105, after deductions authorized by law, [among the several counties] to the Superintendent of Public Instruction semiannually [commencing on January 1, 1983], or more frequently if the State Land Board so orders[,]. The superintendent shall immediately apportion the amount transferred among the counties in proportion to the number of children resident [therein] in each county between the ages of 4 and 20 as determined pursuant to ORS 190.510 to 190.610. [The amount apportioned to each county shall, within 30 days, be placed in the custody of the county treasurer, who shall report the same to the administrative office for the county for distribution among the school districts of the county.] The superintendent shall distribute to each school district within a county a share of the county’s apportionment that is based on the district’s average daily membership that resides within the county.
SECTION 2. ORS 327.420 is amended to read:
327.420. (1) The basis of all apportionments of the Common School Fund shall be the reports of the resident average daily membership for the preceding fiscal year as reported by the school district to the [administrative office for the county and on file therein at the time of making such apportionments] Department of Education.
(2) In the case of a joint school district, the resident average daily membership reported to the [administrative office of the counties comprising the district] department shall be prorated between the counties as the resident enrollment of the district is prorated between the counties.
SECTION 3. ORS 327.415 is repealed.
