Chapter 440 Oregon Laws 2005

 

AN ACT

 

HB 5162

 

Relating to state financial administration; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. Notwithstanding any other provision of law, the General Fund appropriation made to the Department of Education by section 1 (1), chapter 723, Oregon Laws 2003, for the biennium ending June 30, 2005, as modified by Emergency Board action, is decreased by $1,101,000, and the General Fund appropriation made to the department for the State School Fund by section 31, chapter 710, Oregon Laws 2003, for the fiscal year beginning July 1, 2004, as modified by Emergency Board action, is increased by $1,101,000.

 

          SECTION 2. Notwithstanding any other provision of law, the General Fund appropriation made to the Public Defense Services Commission by section 1 (3), chapter 635, Oregon Laws 2003, for the biennium ending June 30, 2005, as modified by Emergency Board action, is decreased by $198,000, and the General Fund appropriation made to the commission by section 1 (1), chapter 635, Oregon Laws 2003, for the biennium ending June 30, 2005, as modified by Emergency Board action, is increased by $198,000.

 

          SECTION 3. Notwithstanding any other law limiting expenditures of the State Board of Examiners for Speech-Language Pathology and Audiology for the payment of expenses of the board from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2005, the limitation on expenditures for the board established by section 9, chapter 504, Oregon Laws 2003, as modified by Emergency Board action, is increased by $7,100.

 

          SECTION 4. Notwithstanding any other law limiting expenditures of the Oregon Liquor Control Commission for the payment of expenses of the commission from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2005, the limitation on expenditures for the commission established by section 1 (2), chapter 718, Oregon Laws 2003, as modified by Emergency Board action, is increased by $222,000.

 

          SECTION 5. Notwithstanding any other law limiting expenditures of the Oregon Military Department for the payment of expenses of the department from federal funds collected or received by the department for the biennium ending June 30, 2005, the limitation on expenditures for the department established by section 3, chapter 620, Oregon Laws 2003, as modified by Emergency Board action, is increased by $2,100,000.

 

          SECTION 6. Notwithstanding any other law limiting expenditures of the Department of State Police for the payment of expenses of the department from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds, for the biennium ending June 30, 2005, the limitation on expenditures for the department established by section 2 (3), chapter 666, Oregon Laws 2003, as modified by Emergency Board action, is increased by $482,887.

 

          SECTION 7. Notwithstanding any other law limiting expenditures of the Housing and Community Services Department for the payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the department for lottery bonds for the biennium ending June 30, 2005, the limitation on expenditures for the department established by section 3, chapter 679, Oregon Laws 2003, as modified by section 23, chapter 732, Oregon Laws 2003, and by Emergency Board action, is increased by $30,000.

 

          SECTION 8. Notwithstanding any other law limiting expenditures of the Housing and Community Services Department for the payment of expenses of the department from federal funds collected or received by the department, other than those described in section 2, chapter 679, Oregon Laws 2003, for the biennium ending June 30, 2005, the limitation on expenditures for the department established by section 4, chapter 679, Oregon Laws 2003, as modified by Emergency Board action, is increased by $6,500,000.

 

          SECTION 9. Notwithstanding any other law limiting expenditures of the Department of Transportation for the payment of expenses of the department from fees, moneys or other revenues, including Miscellaneous Receipts and federal funds received as reimbursement from the United States Department of Transportation, collected or received by the Department of Transportation for the biennium ending June 30, 2005, the limitation on expenditures for the Department of Transportation established by section 81 (3), chapter 710, Oregon Laws 2003, as modified by Emergency Board action, is increased by $35,000,000.

 

          SECTION 10. This 2005 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2005 Act takes effect on its passage.
