Chapter 556 Oregon Laws 2005

 

AN ACT

 

HB 5141

 

Relating to state financial administration; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. For the purpose of carrying out the provisions of ORS 291.055 (1)(e), the following new or increased fees, adopted or modified by the Department of Environmental Quality by rule and approved by the Oregon Department of Administrative Services, are approved:

 

      (1)    Permitting fees for systems

              not subject to water pollution

              control facility permits:

      (a)    Construction-installation

              permit fee:

      (A)   Alternative treatment

              technologies...........................................    $       950

      (B)   Holding tanks........................................    $       540

      (C)   Recirculating gravel filter....................    $       950

      (b)   Alternative system inspection

              fee: Holding tanks.................................    $       240

      (c)    Annual report evaluation fee:

              Commercial sand filters,

              recirculating gravel filters

              and alternative treatment

              technology.............................................    $         50

      (2)    Federal Water Pollution

              Control Act, section 401

              certification fees:

      (a)    Removal fees:

      (A)   500 cubic yards to

              9,999 cubic yards..................................    $       950

      (B)   10,000 cubic yards to

              99,999 cubic yards................................    $    2,800

      (C)   100,000 cubic yards to

              999,999 cubic yards..............................    $    4,700

      (D)   1,000,000 cubic yards to

              9,999,999 cubic yards...........................    $  14,000

      (E)   10,000,000 cubic yards

              or more, the greater of.........................    $  16,000

              or the actual full-time

              equivalent (FTE)

      (b)   Fill fees:

          SECTION 2. This 2005 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2005 Act takes effect on July 1, 2005.
