AN ACT

SB 5608

Relating to state financial administration; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

SECTION 1. For the purpose of carrying out the provisions of ORS 291.055 (1)(e), the following new or increased fees, adopted by the State Department of Agriculture and approved by the Oregon Department of Administrative Services, are approved:

(1) Fertilizer, agricultural

amendment and agricultural

mineral inspection........................... $ 0.35/ton

(2) Virus fruit tree

certification..................................... $ 7 per test

per plant

(3) Annual nursery

participation fee.............................. $ 200

SECTION 2. For the purpose of carrying out the provisions of ORS 291.055 (1)(e), the following new or increased fees, adopted by the State Department of Agriculture and approved by the Oregon Department of Administrative Services, are approved:

(1) Livestock brand renewal

(no change in expiration)

- Nonsheep....................................... $ 100/4 years

(2) Livestock brand renewal

(no change in expiration)

- Sheep............................................. $ 40/4 years

(3) Livestock brand renewal

- Nonsheep....................................... $ 25 per year

(4) Livestock brand renewal

- Sheep............................................. $ 10 per year

(5) Reactivation fee.............................. $ 25

SECTION 3. For the purpose of carrying out the provisions of ORS 291.055 (1)(e), the following new or increased fees, adopted by the State Department of Agriculture and approved by the Oregon Department of Administrative Services, are approved:

(1) Pesticide operator........................... $ 90

(2) Pesticide applicator......................... $ 50

(3) Pesticide trainee.............................. $ 50

(4) Public applicator or trainee........... $ 50

(5) Pesticide dealer............................... $ 75

(6) Consultant....................................... $ 40

SECTION 4. For the purpose of carrying out the provisions of ORS 291.055 (1)(e), the following new or increased fees, adopted by the State Department of Agriculture and approved by the Oregon Department of Administrative Services, are approved:

(1) Registration of animal

remedy, pharmaceutical

or veterinary biologic

product............................................ $ 75 per product

(2) Autogenous products

formulated....................................... $ 75 per product

SECTION 5. This 2005 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2005 Act takes effect July 1, 2005.
