Chapter 745 Oregon Laws 2005

 

AN ACT

 

SB 496

 

Relating to federal forest programs; amending ORS 526.065; and declaring an emergency.

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. ORS 526.065 is amended to read:

          526.065. (1) The State Forestry Department may receive gifts, grants, bequests, endowments and donations of moneys, labor or materials from public and private sources for the purpose of contributing to the management and enhancement of state forests, including but not limited to activities such as recreation, education, interpretation, research and monitoring, cultural resources management and habitat improvement.

          (2) The department may apply for, accept and utilize grants from the federal government to accomplish the goals of a federal forest legacy program, if:

          (a) The proposed forest legacy land area is wholly within an urban growth boundary contained in an acknowledged local comprehensive plan at the time of application for the grant or will be wholly within the boundary by the time the grant is awarded;

          (b) The use to which the land area will be put is an allowable use under the local comprehensive plan; and

          (c) The use complies with all other land use laws and regulations.

          (3) On or before January 15 of each odd-numbered year, the State Forester shall report to the committee created by ORS 171.555 and to any legislative committee with responsibility for forestry issues regarding:

          (a) The number and monetary amounts of grants applied for under the federal forest legacy program;

          (b) The number and monetary amounts of grants awarded under the federal forest legacy program; and

          (c) The location and disposition of areas affected by the federal forest legacy program.

          [(2)] (4) The [State Forestry] department shall deposit moneys received under this section into the State Forest Enhancement Donation Subaccount created under ORS 526.060. The department may expend moneys, materials or labor received under this section only for the purposes specified in the gift, grant, bequest, endowment or donation. If no purpose is specified, the department may use the moneys, materials or labor for the management and enhancement of state forests.

 

          SECTION 2. This 2005 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2005 Act takes effect on its passage.
