Chapter 783 Oregon Laws 2005
AN ACT
HB 5164
Relating to state financial administration; appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. There is appropriated to the Economic and Community Development Department, for the biennium beginning July 1, 2005, out of the General Fund, the amount of $1,271,458 for the Oregon Arts Commission.
SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2005, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Economic and Community Development Department, for the following purposes:
(1) Administration of department

SECTION 3. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2005, as the maximum limits for payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the Economic and Community Development Department, for the following purposes:

SECTION 4. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2005, as the maximum limits for payment of expenses from federal funds collected or received by the Economic and Community Development Department, for the following purposes:

SECTION 5. For the biennium beginning July 1, 2005, expenditures by the Economic and Community Development Department for loans from the following funds are not limited:

SECTION
6. (1) In addition to and not in
lieu of any other allocation from the Administrative Services Economic
Development Fund, there is allocated for the fiscal year beginning July 1,
2006, from the Administrative Services Economic Development Fund to the
Economic and Community Development Department for the Oregon Community
Development Fund, the amount in the Administrative Services Economic
Development Fund during the biennium beginning July 1, 2005, up to $3,350,000,
that has not been allocated by any other law for specific purposes.
(2) Notwithstanding any other law limiting expenditures of the Economic and Community Development Department for payment of expenses of the department from lottery moneys allocated from the Administrative Services Economic Development Fund to the department for the Oregon Community Development Fund, for the fiscal year beginning July 1, 2006, the limitation on expenditures for the department established by section 3 (2) of this 2005 Act is increased by $3,350,000.
SECTION 7. This 2005 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2005 Act takes effect July 1, 2005.
