SUMMARY

introduced.
Creates Rail Advisory Committee for purpose of advising
Department of Transportation on issues, policies and programs
that affect development and provision of rail freight and rail
passenger facilities and services in Oregon.
A BILL FOR AN ACT
Relating to Rail Advisory Committee.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2005 Act is added to and made
a part of ORS chapter 824. + }
SECTION 2. { + (1) The Rail Advisory Committee is created for
the purpose of advising the Department of Transportation about:
(a) Public and private measures to finance improvements to rail
facilities and services.
(b) Statewide and regional policies and actions that affect
rail facilities and services.
(c) The development of policy and planning documents that
affect rail facilities and services.
(d) The need for improvements to rail facilities and services
to support Oregon's economy.
(e) Any other issues, policies and programs that affect the
development and provision of rail freight and rail passenger
facilities and services in Oregon.
(2) In addition to the duties described in subsection (1) of
this section, the advisory committee shall advise the department
and regional advisory groups about projects to develop and
improve rail facilities and services.
(3) The advisory committee shall consist of seven members
appointed by the Director of Transportation. The members shall
include representatives from Class I railroads, short line
railroads, passenger railroads, rail passengers, local
governments, ports and industries that transport goods by rail.
(4) The term of an advisory committee member is four years. A
member is eligible for reappointment to the advisory committee.
Vacancies shall be filled by appointment for the unexpired term.
(5) A majority of the members of the advisory committee
constitutes a quorum for the transaction of business.
(6) Official action by the advisory committee requires the
approval of a majority of the members of the advisory committee.
(7) The advisory committee shall elect one of its members to
serve as chairperson and one of its members to serve as vice
chairperson.
(8) The advisory committee shall meet at least three times a
year and at any other times and places specified by the call of
the chairperson or of a majority of the members of the advisory
committee.
(9) The advisory committee may adopt rules necessary for the
operation of the advisory committee.
(10) The Department of Transportation shall provide policy and
support staff to the advisory committee. The department also
shall provide other personnel to assist the advisory committee as
requested by the chairperson and within the limits of available
funds.
(11) Members of the advisory committee are not entitled to
compensation, but may be reimbursed for actual and necessary
travel and other expenses incurred by them in the performance of
their official duties in the manner and amounts provided for in
ORS 292.495. Claims for expenses shall be paid out of funds
appropriated to the Department of Transportation for that
purpose. + }
SECTION 3. { + Notwithstanding section 2 of this 2005 Act, the
first appointments to the Rail Advisory Committee shall be for
terms of one, two, three or four years, as designated by the
Director of Transportation, so that the terms of office of no
more than three members expire in the same year. + }
