SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Prohibits state and local educational agencies from
participating in federal No Child Left Behind Act of 2001 if
adequate federal funding is not received. Directs State Board of
Education to find whether adequate funding is received.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to federal education law; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section, 'state and local
educational agencies' means:
(a) The Superintendent of Public Instruction;
(b) The State Board of Education;
(c) The Department of Education;
(d) The Teacher Standards and Practices Commission;
(e) School districts;
(f) Education service districts; and
(g) Public charter schools.
(2) For each school year, the State Board of Education shall
find whether Oregon will receive adequate federal funding to
implement the federal No Child Left Behind Act of 2001
(P.L. 107-110, 115 Stat. 1425) for the school year. Prior to
September 1 of each school year, the board shall notify the other
state and local educational agencies of its finding.
(3) State and local educational agencies may not enter into any
contract or other agreement or otherwise expend moneys to
implement the federal No Child Left Behind Act of 2001
(P.L. 107-110, 115 Stat. 1425) for any school year for which the
State Board of Education has made a finding that Oregon will not
receive adequate federal funding to implement the federal Act for
that school year. + }
SECTION 2. { + (1) Section 1 of this 2005 Act first applies to
the 2005-2006 school year.
(2) Section 1 of this 2005 Act applies to any contracts or
agreements entered into on or after September 1, 2005. + }
SECTION 3. { + This 2005 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2005 Act takes effect on its
passage. + }
