                             SUMMARY
 
The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.
 
  Appropriates moneys from General Fund to Department of
Transportation for certain biennial expenses.
  Limits biennial expenditures from fees, moneys or other
revenues, including Miscellaneous Receipts and certain federal
funds, but excluding lottery funds, collected or received by
department.
  Limits biennial expenditures of department from certain federal
funds.
  Authorizes specified nonlimited expenditures.
  Limits biennial expenditures from lottery funds received by
department for specified projects.
  Declares emergency, effective July 1, 2005.
 
                        A BILL FOR AN ACT
Relating to the financial administration of the Department of
  Transportation; appropriating money; limiting expenditures; and
  declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + There is appropriated to the Department of
Transportation, for the biennium beginning July 1, 2005, out of
the General Fund, the amount of $9,026,167 for rail purposes. + }
  SECTION 2.  { + Notwithstanding any other law limiting
expenditures, the following amounts are established for the
biennium beginning July 1, 2005, as the maximum limits for
payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts and federal funds received as
reimbursement from the United States Department of
Transportation, but excluding lottery funds, collected or
received by the Department of Transportation, for the following
purposes: + }

  SECTION 4.  { + Notwithstanding any other law limiting
expenditures, the amount of $33,187,224 is established for the
biennium beginning July 1, 2005, as the maximum limit for payment
of expenses from lottery moneys allocated from the Administrative
Services Economic Development Fund to the Department of
Transportation for Westside Light Rail, South Metro Commuter
Rail, Short Line Infrastructure assistance, multimodal
infrastructure, and Industrial Rail Spur assistance debt
service. + }
  SECTION 5.  { + For the biennium beginning July 1, 2005, the
following expenditures are not limited:
  (1) Expenditures by the Oregon Board of Maritime Pilots from
the Pilot Account established under ORS 776.365 for costs related
to rate setting hearings;
  (2) Expenditures by the Department of Transportation from the
Department of Transportation Driver and Motor Vehicle Suspense
Account and the Department of Transportation Driver and Motor
Vehicle Services Administrative Account established under ORS
802.100 for debt service and for internally reimbursed
expenditures;
  (3) Expenditures by the Department of Transportation from the
State Highway Fund established under ORS 366.505 for debt service
and for internally reimbursed expenditures; and
  (4) Expenditures by the Department of Transportation from the
Oregon Transportation Infrastructure Fund established under ORS
367.015 for debt service and for internally reimbursed
expenditures. + }
  SECTION 6.  { + This 2005 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2005 Act takes effect July 1,
2005. + }
