AN ACT
Relating to driver training; amending ORS 822.500 and 822.525.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 822.500 is amended to read:
822.500. (1) A person commits the offense of operating a
commercial driver training school without a certificate if the
person is not the holder of a valid, current driver training
school certificate issued under ORS 822.515 and the person
operates a business or nonprofit enterprise that engages, for a
consideration, in educating and training persons, either
practically or theoretically, or both, in the driving of motor
vehicles.
(2) The offense described in this section does not apply
to { + :
(a) + } A business or nonprofit enterprise engaged in educating
and training persons for a profession { + ; + } { - or - }
{ + (b) + } An accredited secondary school, college or
university { - . - } { + ; or
(c) A person that provides limited education or training for a
specialized purpose, as determined by the Department of
Transportation by rule. + }
(3) The offense described in this section, operating a
commercial driver training school without a certificate, is a
Class A misdemeanor.
SECTION 2. ORS 822.525 is amended to read:
822.525. (1) A person commits the offense of acting as a driver
training instructor without a certificate if the person is not
the holder of a valid, current driver training instructor
certificate issued under ORS 822.530 and the person, for
compensation, teaches, conducts classes or gives demonstrations
to or supervises practice of persons in the driving of motor
vehicles whether acting on the person's own behalf or acting as
an operator of or on behalf of any business or nonprofit
enterprise or school engaged in educating and training persons,
either practically or theoretically, or both, in the driving of
motor vehicles.
(2) The offense described in this section does not apply to a
person acting as an operator of or on behalf of:

(a) A business or nonprofit enterprise engaged in educating and
training persons for a profession; { - or - }
(b) An accredited secondary school, college or university

(c) A person that provides limited education or training for a

(3) The offense described in this section, acting as a driver
training instructor without a certificate, is a Class A
misdemeanor.
