brief statement of the essential features of the measure as
introduced.
 
  Prohibits insurer that issues personal insurance policies from
using consumer's credit history to cancel, nonrenew, decline
coverage, calculate insurance score, determine premiums or set
payment plan for personal insurance.
 
                        A BILL FOR AN ACT
Relating to personal insurance; creating new provisions; and
  repealing ORS 746.661, 746.662 and 746.663.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + ORS 746.661, 746.662 and 746.663 are
repealed. + }
  SECTION 2.  { + Section 3 of this 2005 Act is added to and made
a part of ORS 746.600 to 746.690. + }
  SECTION 3.  { + An insurer that issues personal insurance
policies in this state may not use a consumer's credit history in
whole or in part to do any of the following:
  (1) Cancel or nonrenew personal insurance.
  (2) Decline coverage of personal insurance in the initial
underwriting decision. An offer of placement with an affiliate
insurer constitutes a declination of insurance coverage.
  (3) Calculate an insurance score.
  (4) Determine insurance premiums or rates.
  (5) Require a particular payment plan. + }
  SECTION 4.  { + This 2005 Act applies only to personal
insurance policies issued or renewed on or after the effective
date of this 2005 Act. + }
