  Requires health insurance coverage for prescription
contraceptives.
 
                        A BILL FOR AN ACT
Relating to health insurance.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2005 Act is added to and made
a part of the Insurance Code. + }
  SECTION 2.  { + (1) As used in this section, 'prescription
contraceptive' means a drug or device approved by the United
States Food and Drug Administration to prevent conception.
  (2) A health insurance policy that covers hospital, medical or
surgical expenses, other than coverage limited to expenses from
accidents or specific diseases, and that provides a prescription
drug benefit shall provide payment, coverage or reimbursement
for:
  (a) Prescription contraceptives; and
  (b) Outpatient consultations, examinations, procedures and
medical services that are necessary to prescribe, dispense,
deliver, distribute, administer or remove a prescription
contraceptive required to be covered under this subsection.
  (3) The coverage required by subsection (2) of this section may
be made subject to provisions of the health insurance policy that
apply to other prescription drug benefits under the policy,
including but not limited to provisions relating to deductibles
and coinsurance. + }
  SECTION 3.  { + Section 2 of this 2005 Act applies to:
  (1) Health care service contractors as defined in ORS 750.005;
and
  (2) Trusts carrying out a multiple employer welfare arrangement
as defined in ORS 750.301. + }
  SECTION 4.  { + A practitioner as defined in ORS 689.005 is not
required to give advice with respect to or participate in the
coverage required by section 2 of this 2005 Act. A practitioner
who makes this election must notify a patient of the
practitioner's election at the time the patient seeks the
services described in section 2 of this 2005 Act. + }
 
  SECTION 5.  { + Section 2 of this 2005 Act applies to health
insurance policies issued or renewed on or after the effective
date of this 2005 Act. + }
