introduced.
 
  Appropriates moneys from General Fund to Oregon Department of
Administrative Services for biennial expenses.
  Limits certain biennial expenditures from fees, moneys or other
revenues, including Miscellaneous Receipts, but excluding lottery
funds and federal funds, collected or received by department.
  Limits biennial expenditures of department from certain lottery
moneys.
  Authorizes specified nonlimited expenditures.
  Declares emergency, effective July 1, 2005.
 
                        A BILL FOR AN ACT
Relating to the financial administration of the Oregon Department
  of Administrative Services; appropriating money; limiting
  expenditures; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + There is appropriated to the Oregon Department
of Administrative Services, for the biennium beginning July 1,
2005, out of the General Fund, the amount of $8,012,086. + }
  SECTION 2.  { + Notwithstanding any other law limiting
expenditures, the following amounts are established for the
biennium beginning July 1, 2005, as the maximum limits for
payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and
federal funds, collected or received by the Oregon Department of
Administrative Services, for the following purposes: + }

  SECTION 3.  { + Notwithstanding any other law limiting
expenditures, the amount of $1,622,118 is established for the
biennium beginning July 1, 2005, as the maximum limit for payment
of expenses by the Oregon Department of Administrative Services
from lottery moneys allocated from the Administrative Services
Economic Development Fund for debt service and related costs on
outstanding Oregon Public Broadcasting Corporation and Southern
Oregon Public Television Corporation bonds issued during the
biennium ending June 30, 2005. + }
  SECTION 4.  { + Notwithstanding any other law limiting
expenditures, the amount of $3,330,656 is established for the
biennium beginning July 1, 2005, as the maximum limit for payment
of expenses to support the county fairs in this state from
lottery moneys allocated from the Administrative Services
Economic Development Fund to the Oregon Department of
Administrative Services that are deposited in the County Fair
Account established under ORS 565.445. + }
  SECTION 5.  { + Notwithstanding any other law limiting
expenditures, the amount of $59,000 is established for the
biennium beginning July 1, 2005, as the maximum limit for the
payment of expenses from federal funds collected or received by
the Oregon Department of Administrative Services. + }
  SECTION 6.  { + For the biennium beginning July 1, 2005, the
following expenditures by the Oregon Department of Administrative
Services are not limited:
  (1) Expenditures from the Oregon Department of Administrative
Services Operating Fund for the following purposes:
  (a) Materials for resale paid for or purchased by the
department;
  (b) Transfer of standard passenger vehicles to the motor pool
pursuant to ORS 283.320 and replacement of vehicles damaged
beyond economical repair;
  (c) Acquiring fuel, tires, parts, shop supplies, sublet repairs
and batteries for motor pool vehicles;
  (d) Acquiring, purchasing, shipping, handling, warehousing,
storing, transporting and distributing surplus property;
  (e) Telephone toll, transmission and exchange, engineering,
acquisition and installation charges and costs, including but not
limited to contracted personal services, equipment, equipment
maintenance, switch gear and other related costs associated with
operating the state telecommunications network and service;
  (f) Acquiring telecommunications equipment pursuant to ORS
276.218;
  (g) Furnishing services, including labor, to other than state
agencies pursuant to ORS 190.240;
  (h) Administrative hearings pursuant to ORS 279C.450 (1), (2),
(3) and (7);
  (i) Electricity, garbage, sewer, water, fuels, gas and steam
costs associated with operating facilities under the control of
the Facilities Division;
  (j) Reimbursable payments for training and employee exchange
programs;
  (k) Interest payments while approved facilities are under
construction, bond counsel and underwriters' fees, legal fees or
other fees associated with financing as may be required by the
financial institutions;
  (L) Inks, plates, film, paper, purchased printing, equipment
leasing, equipment maintenance charges, freight and shipping
charges and materials and merchandise for resale by the
 
Publishing and Distribution Section of the Information Resources
Management Division;
  (m) Charges related to operation of the statewide financial
management system for processing state warrants and other
payments and charges for computer processing and systems
development; and
  (n) Charges related to operation of the statewide Position and
Personnel Data Base (PPDB) system and charges for computer
processing and systems development.
  (2) Expenditures from the Insurance Fund for acquiring and
purchasing insurance or reinsurance, allocating and collecting
premiums and paying claims for coverage pursuant to statutory
authority.
  (3) Expenditures from the Mass Transit Assistance Account for
payments described in ORS 291.407 to mass transit districts,
transportation districts and service districts.
  (4) Expenditures from the Public Employees' Benefit Account for
annual open enrollment costs incurred by the Public Employees'
Benefit Board.
  (5) Expenditures from the Public Employees' Revolving Fund for
administration of dependent care assistance as authorized by ORS
243.221 (2)(c) and expense reimbursement plans as authorized by
ORS 243.221 (2)(d).
  (6) Expenditures from the Public Employees' Revolving Fund for
rate stabilization. + }
  SECTION 7.  { + Except as provided in sections 2 and 3 of this
2005 Act, expenditures by the Oregon Department of Administrative
Services for debt service are not limited for the biennium
beginning July 1, 2005. + }
  SECTION 8.  { + This 2005 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2005 Act takes effect July 1,
2005. + }
