Chapter 104 Oregon Laws 2007

 

AN ACT

 

SB 5545

 

Relating to state financial administration; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

JUDICIAL DEPARTMENT

 

          SECTION 1. Notwithstanding any other provision of law, the General Fund appropriation made to the Judicial Department by section 1 (2), chapter 604, Oregon Laws 2005, for the biennium ending June 30, 2007, as modified by Emergency Board action, is increased by $1,657,462 for increased costs for sign and spoken language interpreters in the court system.

 

PUBLIC DEFENSE SERVICES COMMISSION

 

          SECTION 2. Notwithstanding any other provision of law, the General Fund appropriation made to the Public Defense Services Commission by section 1 (2), chapter 552, Oregon Laws 2005, for the biennium ending June 30, 2007, as modified by Emergency Board action, is increased by $1,057,517 for public defense contract services for the remainder of the biennium ending June 30, 2007.

 

DEPARTMENT OF JUSTICE

 

          SECTION 3. Notwithstanding any other provision of law, the General Fund appropriation made to the Department of Justice by section 1, chapter 694, Oregon Laws 2005, for the biennium ending June 30, 2007, as modified by Emergency Board action, is increased by $443,663 for the purpose of paying for legal costs through February 2007 of protecting the state’s interest in Master Settlement Agreement payments.

 

OFFICE OF THE GOVERNOR

 

          SECTION 4. Notwithstanding any other provision of law, the General Fund appropriation made to the Office of the Governor by section 1, chapter 719, Oregon Laws 2005, for the biennium ending June 30, 2007, as modified by Emergency Board action, is increased by $46,200 for the purpose of replacing necessary office equipment.

 

DEPARTMENT OF COMMUNITY COLLEGES

AND WORKFORCE DEVELOPMENT

 

          SECTION 5. (1) Notwithstanding any other law limiting expenditures of the Department of Community Colleges and Workforce Development for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2007, the limitation on expenditures for the department established by section 2 (1), chapter 792, Oregon Laws 2005, as modified by Emergency Board action, is decreased by $120,000.

          (2) Notwithstanding any other law limiting expenditures of the Department of Community Colleges and Workforce Development for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2007, the limitation on expenditures by the department for the Oregon Youth Conservation Corps established by section 2 (2), chapter 792, Oregon Laws 2005, as modified by Emergency Board action, is increased by $120,000.

 

DEPARTMENT OF HIGHER EDUCATION

 

          SECTION 6. Notwithstanding any other law limiting expenditures of the Department of Higher Education for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, for the biennium ending June 30, 2007, the limitation on expenditures for the department established by section 2 (1), chapter 781, Oregon Laws 2005, as amended by section 2a (1), chapter 781, Oregon Laws 2005, and as modified by Emergency Board action, is increased by $3,000,000.

 

DEPARTMENT OF TRANSPORTATION

 

          SECTION 7. Notwithstanding any other law limiting expenditures of the Department of Transportation for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts and certain federal funds, but excluding lottery funds, for the biennium ending June 30, 2007, the limitations on expenditures for the department established by section 2, chapter 721, Oregon Laws 2005, as modified by Emergency Board action, are increased by the following amounts for the following purposes:

          (1) The limitation for maintenance and emergency relief programs under section 2 (2), chapter 721, Oregon Laws 2005, is increased by $10,074,515.

          (2) The limitation for the highway safety program under section 2 (5), chapter 721, Oregon Laws 2005, is increased by $4,473,122.

          (3) The limitation for special programs under section 2 (8), chapter 721, Oregon Laws 2005, is increased by $4,911,997.

          (4) The limitation for public transit under section 2 (14), chapter 721, Oregon Laws 2005, is increased by $1,481,000.

 

          SECTION 8. Notwithstanding any other law limiting expenditures of the Department of Transportation for the payment of expenses of the department from federal funds, for the biennium ending June 30, 2007, the limitation on expenditures by the department for driver and motor vehicle services established by section 3 (7), chapter 721, Oregon Laws 2005, as modified by Emergency Board action, is increased by $80,000.

 

STATE FORESTRY DEPARTMENT

 

          SECTION 9. Notwithstanding any other law limiting expenditures of the State Forestry Department for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and certain federal funds, for the biennium ending June 30, 2007, the limitation on expenditures by the department for protection from fire established by section 2 (2), chapter 791, Oregon Laws 2005, as modified by Emergency Board action, is increased by $12,400,000.

 

          SECTION 10. Notwithstanding any other provision of law, the General Fund appropriation made to the State Forestry Department by section 1 (3), chapter 791, Oregon Laws 2005, for the biennium ending June 30, 2007, as modified by Emergency Board action, is increased by $300,000 for the purpose of providing ongoing monitoring and eradication treatments for the disease of sudden oak death in Curry County, Oregon.

 

OREGON MILITARY DEPARTMENT

 

          SECTION 11. (1) Notwithstanding any other law limiting expenditures of the Oregon Military Department for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and certain federal funds, for the biennium ending June 30, 2007, the limitation on expenditures by the department for community support established by section 2 (3), chapter 673, Oregon Laws 2005, as modified by Emergency Board action, is increased by $2,595,327.

          (2) Notwithstanding any other provision of law, the General Fund appropriation made to the Oregon Military Department by section 5, chapter 782, Oregon Laws 2005, for the biennium ending June 30, 2007, for the purpose of reimbursing persons for the costs of resident annual hunting licenses and resident annual angling licenses, as modified by Emergency Board action, is decreased by $154,000.

          (3) Notwithstanding any other provision of law, the General Fund appropriation made to the Oregon Military Emergency Financial Assistance Fund by section 3, chapter 793, Oregon Laws 2005, for the biennium ending June 30, 2007, as modified by Emergency Board action, is increased by $154,000.

          (4) Notwithstanding any other law limiting expenditures of the Oregon Military Department for the payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and certain federal funds, for the biennium ending June 30, 2007, the limitation on expenditures by the department for the Oregon Military Emergency Financial Assistance Fund established by section 4, chapter 793, Oregon Laws 2005, as modified by Emergency Board action, is increased by $154,000.

 

MISCELLANEOUS

 

          SECTION 12. The unit captions used in this 2007 Act are provided only for the convenience of the reader and do not become part of the statutory law of this state or express any legislative intent in the enactment of this 2007 Act.

 

          SECTION 13. This 2007 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2007 Act takes effect on its passage.
