Chapter 168 Oregon Laws 2007
AN ACT
SB 516
Relating to sanitary districts; creating new provisions; and amending
ORS 450.045.
Be It Enacted by the People of
the State of Oregon:
SECTION 1.
ORS 450.045 is amended to read:
450.045. (1) The power
and authority given a sanitary district, except as otherwise provided, shall be
exercised by a board of three or five members, according to the number set
forth in the petition for formation.
(2) A person is
qualified to be a member of the board if the person is an elector of or
owner in the district.
(3) If the first board
to be elected has three members:
(a) The terms of the
candidates receiving the highest and second highest votes expire June 30 next
following the second regular district election.
(b) The term of the
candidate receiving the third highest vote expires June 30 next following the
first regular district election.
(4) If the first board
to be elected has five members:
(a) The terms of the
candidates receiving the first, second and third highest votes expire June 30
next following the second regular district election.
(b) The term of the
candidate receiving the fourth or fifth highest vote expires June 30 next
following the first regular district election.
SECTION 2. The
amendments to ORS 450.045 by section 1 of this 2007 Act apply to a vacancy in a
district board that occurs on or after the effective date of this 2007 Act.
