AN ACT

Relating to students; and declaring an emergency.
Be It Enacted by the People of
the State of
SECTION 1. As used in sections 2 and 3 of this 2007
Act:
(1) “Anabolic steroid”
includes any drug or hormonal substance chemically or pharmacologically related
to testosterone, all prohormones, including dehydroepiandrosterone and all
substances listed in the Anabolic Steroid Control Act of 2004. “Anabolic
steroid” does not include estrogens, progestins, corticosteroids and
mineralocorticoids.
(2) “Performance-enhancing
substance” means a manufactured product for oral ingestion, intranasal
application or inhalation containing compounds that:
(a) Contain a stimulant,
amino acid, hormone precursor, herb or other botanical or any other substance
other than an essential vitamin or mineral; and
(b) Are intended to
increase athletic performance, promote muscle growth, induce weight loss or
increase an individual’s endurance or capacity for exercise.
(3) “School district
employee” means:
(a) An administrator,
teacher or other person employed by a school district;
(b) A person who
volunteers for a school district; and
(c) A person who is
performing services on behalf of a school district pursuant to a contract.
SECTION 2. A school district employee may not:
(1) Knowingly sell,
market or distribute an anabolic steroid or performance-enhancing substance to
a kindergarten through grade 12 student with whom the employee has contact as
part of the employee’s school district duties; or
(2) Knowingly endorse or
suggest the ingestion, intranasal application or inhalation of an anabolic
steroid or performance-enhancing substance by a kindergarten through grade 12
student with whom the employee has contact as part of the employee’s school
district duties.
SECTION 3. (1) The Department of Education shall work
in conjunction with voluntary organizations approved to administer
interscholastic activities under ORS 339.430 to develop and implement a program
for kindergarten through grade 12 students of evidence-based education to
prevent the use of anabolic steroids and performance-enhancing
substances.
(2) The department and
school districts shall include information on anabolic steroids and
performance-enhancing substances, including prevention strategies,
strength-building alternatives and the understanding of health food labels, in
health and physical education curricula.
(3) The department shall
ensure that school districts are utilizing programs such as the Oregon Health
and Science University’s Athletes Training and Learning to Avoid Steroids
(ATLAS) and Athletes Targeting Healthy Exercise and Nutrition Alternatives
(ATHENA), which have demonstrated effectiveness in reducing anabolic steroid
and performance-enhancing substance use by high school athletes.
(4) The department shall
require school district employees who are coaches or athletic directors to
receive training once every four years on identifying the components of
anabolic steroid abuse and use and prevention strategies for the use of
performance-enhancing substances.
SECTION 4. Prior to October 1, 2008, the Department of
Education shall report to the Governor and the interim committees on education
on the implementation of sections 2 and 3 of this 2007 Act.
SECTION 5. Sections 2 and 3 of this 2007 Act first
apply to the 2007-2008 school year.
SECTION 6. This 2007 Act being necessary for the
immediate preservation of the public peace, health and safety, an emergency is
declared to exist, and this 2007 Act takes effect on its passage.
