Relating to adverse possession.
Be It Enacted by the People of
the State of
SECTION 1. (1) As used in this section:
(a) “Education service
district” has the meaning given that term in ORS 334.003.
(b) “Facility” means a
school described in ORS 346.010.
(c) “Post-secondary
institution” means:
(A) A community college
as defined in ORS 341.005;
(B) A state institution
of higher education listed in ORS 352.002; and
(C) The
(d) “School district”
has the meaning given that term in ORS 330.005.
(2) The interest or
estate of an education service district, a facility, a post-secondary
institution or a school district in any real property may not be extinguished
or diminished by adverse possession.
SECTION 2. Section 1 of this 2007 Act applies to
adverse possession claims for which a suit is filed on or after the effective
date of this 2007 Act, regardless of when the person asserting the claim, or
the predecessors of the person, entered into possession of the property.
