AN ACT

Relating to district attorneys; amending ORS 8.726.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. ORS 8.726 is amended to read:

          8.726. (1) Except as authorized by [subsections (2) and (3) of this section, a district attorney, or a deputy district attorney, who receives an annual salary of more than $18,000 from the state, or from the state and county, shall] subsection (2) of this section, district attorneys and deputy district attorneys may not engage in the private practice of law.

          [(2) A district attorney of Gilliam, Sherman, Wallowa or Wheeler County shall be allowed to engage in the private practice of law, unless the district attorney receives additional compensation from the county under ORS 8.830.]

          [(3)] (2) A district attorney or deputy district attorney may engage in volunteer or pro bono legal work [is not prohibited].
