Chapter 710 Oregon Laws 2007

 

AN ACT

 

HB 5002

 

Relating to financial administration of the State Department of Agriculture; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There are appropriated to the State Department of Agriculture, for the biennium beginning July 1, 2007, out of the General Fund, the following amounts for the following purposes:

 

      (1)    Administrative and Support

              Services............................................     $  1,687,613

      (2)    Food Safety.....................................     $  6,778,530

      (3)    Natural Resources..........................     $  5,068,725

      (4)    Agricultural Development.............     $  2,984,794

 

          SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2007, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, and including federal funds for contract services, but excluding lottery funds and federal funds not described in this section, collected or received by the State Department of Agriculture, for the following purposes:

 

      (1)    Administrative and Support

              Services............................................     $  6,587,619

      (2)    Food Safety.....................................     $ 18,550,269

      (3)    Natural Resources..........................     $ 13,077,983

      (4)    Agricultural Development.............     $  9,771,657

 

          SECTION 3. Notwithstanding any other law limiting expenditures, the amount of $10,160,792 is established for the biennium beginning July 1, 2007, as the maximum limit for payment of expenses from lottery moneys allocated from the Parks and Natural Resources Fund to the State Department of Agriculture for the Oregon Plan, to be used for salmon and watershed activities.

 

          SECTION 4. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2007, as the maximum limits for payment of expenses from federal funds other than those described in section 2 of this 2007 Act collected or received by the State Department of Agriculture, for the following purposes:

 

      (1)    Food Safety.....................................     $     343,761

      (2)    Natural Resources..........................     $  5,795,834

      (3)    Agricultural Development.............     $     162,570

 

          SECTION 5. Notwithstanding any other law limiting expenditures, the amount of $35,190 is established for the biennium beginning July 1, 2007, as the maximum limit for payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the State Department of Agriculture for deposit in the County Fair Account established by ORS 565.445, to support county fairs.

 

          SECTION 6. Notwithstanding any other law limiting expenditures of the State Department of Agriculture for the biennium ending June 30, 2007, the expenditure limitations for the following programs for the biennium ending June 30, 2007, as modified by Emergency Board action, are changed by the amounts specified:

          (1) The expenditure limit on certain federal funds for food safety, established in section 4 (1), chapter 716, Oregon Laws 2005, is decreased by $280,196.

          (2) The expenditure limit on certain federal funds for natural resources, established in section 4 (2), chapter 716, Oregon Laws 2005, is increased by $733,385.

 

          SECTION 7. This 2007 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2007 Act takes effect on its passage.
