AN ACT
SB 5549
Relating to state financial administration; appropriating money;
limiting expenditures; and declaring an emergency.
Be It Enacted by the People of
the State of
SECTION 1. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Emergency Board, for the biennium beginning July 1, 2007, out of the
General Fund, the amount of $30,000,000 for the purposes for which the
Emergency Board lawfully may allocate funds.
SECTION 2. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $125,000,000, to be allocated to state
agencies for state employee compensation changes for the biennium beginning
July 1, 2007. Moneys appropriated by this subsection shall be allocated
proportionately among represented, nonrepresented, management and executive
service positions in state government.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to July 1, 2008, the moneys remaining on that date become
available for any purpose for which the Emergency Board lawfully may allocate
funds.
SECTION 3. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $800,000, to be allocated to the
Department of Education for the Local Option Equalization Grants Account.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 4. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $700,000, to be allocated to the Oregon
Government Standards and Practices Commission for costs associated with
planning and development of an electronic filing system for reports required by
law to be submitted by public officials and lobbyists.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 5. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $1,000,000, to be allocated to the
Department of Justice for ongoing legal costs of the defense of the revenue
stream from the Master Settlement Agreement with tobacco companies.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 6. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $600,000, to be allocated to the
Legislative Administration Committee for the purpose of paying a consultant or
other costs for the Interim Committee on Court Facilities to develop
recommendations for the renovation, construction and maintenance of court
facilities.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 7. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $550,000, to be allocated to the
Legislative Administration Committee for costs associated with planning, debt
service and relocation of legislative and executive branch staff for the
Capitol renovation project.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 8.
(1) In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $9,000,000, to be allocated to the Department
of State Police for additional costs of the

allocate funds.

SECTION 9. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $1,800,000, to be allocated to the
Secretary of State for costs associated with a statewide special election
scheduled to be held on November 6, 2007.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 9a. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Emergency Board, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $2,500,000, to be allocated to state
agencies for continuous improvement projects.
(2) If any of the moneys
appropriated by subsection (1) of this section are not allocated by the
Emergency Board prior to December 1, 2008, the moneys remaining on that date
become available for any purpose for which the Emergency Board lawfully may
allocate funds.
SECTION 10. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Emergency Board by section 1, chapter 794,
SECTION 11. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Department of Land Conservation and Development by section 1 (1), chapter 737,
Oregon Laws 2007 (Enrolled House Bill 5033), for the biennium beginning July 1,
2007, is increased by $1,985,146 for costs associated with processing and
reviewing claims under the provisions of ORS 197.352 (Ballot Measure 37
(2004)).
SECTION 12. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Department of Land Conservation and Development by section 1 (1), chapter 737,
Oregon Laws 2007 (Enrolled House Bill 5033), for the biennium beginning July 1,
2007, is decreased by $400,000.
SECTION 13. (1)
Notwithstanding any other law limiting expenditures, the limitation on
expenditures established by section 3 (1), chapter 107, Oregon Laws 2007
(Enrolled House Bill 5043), for the biennium beginning July 1, 2007, as the
maximum limit for payment of expenses for the Natural Heritage Advisory Council
from federal funds collected or received by the Department of State Lands, is
increased by $750,000.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by section
3 (2), chapter 107, Oregon Laws 2007 (Enrolled House Bill 5043), for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
for the South Slough National Estuarine Research Reserve operations from
federal funds collected or received by the Department of State Lands, is
increased by $100,000.
(3) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2 (2), chapter 107, Oregon Laws 2007 (Enrolled House Bill 5043), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses for the South Slough National Estuarine Research Reserve operations
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the
Department of State Lands, is increased by $75,000.
SECTION 14. Notwithstanding
any other provision of law, the General Fund appropriation made to the Columbia
River Gorge Commission by section 1 (1), chapter 105, Oregon Laws 2007
(Enrolled House Bill 5011), for the biennium beginning July 1, 2007, is
increased by $61,906.
SECTION 15. Notwithstanding
any other law limiting expenditures, the amount of $600,000 is established for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses for the property acquisition program from federal funds collected or
received by the State Parks and Recreation Department.
SECTION 16. (1)
Notwithstanding any other law limiting expenditures, the limitation on
expenditures established by section 2, chapter 139, Oregon Laws 2007 (Enrolled
Senate Bill 5512), for the biennium beginning July 1, 2007, as the maximum
limit for payment of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal funds,
collected or received by the State Department of Energy, is increased by
$4,600,000.
(2) Notwithstanding
any other provision of law, the General Fund appropriation made to the State
Department of Energy by section 1, chapter 139, Oregon Laws 2007 (Enrolled
Senate Bill 5512), for the biennium beginning July 1, 2007, is decreased by
$1,500,000.

SECTION 17. In
addition to and not in lieu of any other appropriation, there are appropriated
to the Water Resources Department, for the biennium beginning July 1, 2007, out
of the General Fund, the following amounts for the following purposes:

SECTION 18. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the State Department of Geology and Mineral Industries, for the
biennium beginning July 1, 2007, out of the General Fund, the amount of
$139,249, which may be expended for costs associated with staffing for the
light detection and ranging project.
(2) Notwithstanding any
other law limiting expenditures, the amount of $1,500,000 is established for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses for the light detection and ranging project from lottery funds
allocated to the State Department of Geology and Mineral Industries from the
Restoration and Protection Research Fund established under ORS 541.378.
(3) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2, chapter 76, Oregon Laws 2007 (Enrolled Senate Bill 5514), for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the State
Department of Geology and Mineral Industries, is increased by $1,500,000 for
the light detection and ranging project.
SECTION 19. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
for the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Oregon Department of Administrative Services is decreased by the following
amounts:

SECTION 20. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Oregon Department of Administrative Services, for the biennium beginning
July 1, 2007, out of the General Fund, the amount of $2,800,000, which may be
expended for payments to the Oregon Historical Society.
SECTION 20a. Notwithstanding
any other provision of law, the General Fund appropriation made to the Economic
and Community Development Department for the Oregon Arts Commission by section
1, chapter 760, Oregon Laws 2007 (Enrolled Senate Bill 5508), for the biennium
beginning July 1, 2007, is increased by $1,000,000 for the Creative Oregon
Initiative.
SECTION 21. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Long Term Care Ombudsman by section 1, chapter 471, Oregon Laws 2007
(Enrolled Senate Bill 5525), for the biennium beginning July 1, 2007, is
increased by $86,664.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2, chapter 471, Oregon Laws 2007 (Enrolled Senate Bill 5525), for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding
lottery funds and federal funds, collected or received by the Long Term Care
Ombudsman is increased by $69,750.
SECTION 21a. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Department of Human Services, for the biennium beginning
July 1, 2007, out of the General Fund, the amount of $95,660 for the purpose of
increasing Oregon Health Plan fee-for-service reimbursement to 75 percent of
Medicare costs for home health care providers.
(2) Notwithstanding any
other provision of law, the General Fund appropriation made to the Department
of Human Services by section 1 (3), chapter 743, Oregon Laws 2007 (Enrolled
House Bill 5031), for the biennium beginning July 1, 2007, is decreased by
$95,660.
SECTION 21b. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Department of Human Services, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $1,511,832, which may be expended for
payments to nursing facilities to increase certified nursing assistant staffing
levels.
SECTION 21c. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Department of Human Services, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $4,000,000, which may be expended for
payments to in-home care workers providing client services in the department’s
long term care program.
SECTION 21d. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Department of Human Services, for the biennium beginning July 1, 2007,
out of the General Fund, the amount $220,000, which may be expended for
independent living centers.
SECTION 22. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Oregon Youth Authority by section 1 (2), chapter 599, Oregon Laws 2007
(Enrolled Senate Bill 5544), for the biennium beginning July 1, 2007, is
increased by $632,668.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2, chapter 599, Oregon Laws 2007 (Enrolled Senate Bill 5544), for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts and
federal funds received from the Department of Education and the Department of
Human Services for nutrition programs and alcohol and drug abuse prevention
programs, but excluding lottery funds and federal funds not described in this
subsection, collected or received by the Oregon Youth Authority is increased by
$99,999.
SECTION 22a. In
addition to and not in lieu of any other appropriation, there is appropriated
to the

SECTION 23. (1)
Notwithstanding any other law limiting expenditures, the limitation on
expenditures established by section 2 (17), chapter 749, Oregon Laws 2007
(Enrolled House Bill 5047), for the biennium beginning July 1, 2007, as the
maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and certain
federal funds, collected or received by the Department of Transportation, is
decreased by $276,566.
(2) Notwithstanding any
other law limiting expenditures, the amount of $276,566 is established for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the Public
Utility Commission for expenses related to the Oregon Board of Maritime Pilots.
SECTION 23a. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2 (8), chapter 749, Oregon Laws 2007 (Enrolled House Bill 5047), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts
and certain federal funds, but excluding lottery funds and certain federal
funds, collected or received by the Department of Transportation, is increased
by $56,250,000 to supplement county road funding.
SECTION 24. (1)
In addition to and not in lieu of any other appropriation, there is
appropriated to the Department of Higher Education, for the biennium beginning
July 1, 2007, out of the General Fund, the amount of $1,000,000, which may be
expended for support of the

SECTION 24a. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2 (4), chapter 702, Oregon Laws 2007 (Enrolled Senate Bill 5515),
for the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Department of Higher Education, is increased by $700,000 for the Forest
Research Laboratory at Oregon State University.
SECTION 24b. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 3, chapter 698, Oregon Laws 2007 (Enrolled House Bill 5012), for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from federal funds other than federal National Emergency Grant funds, collected
or received by the Department of Community Colleges and Workforce Development,
is increased by $3,000,000.
SECTION 24c. In
addition to and not in lieu of any other appropriation, there are appropriated
to the Department of Community Colleges and Workforce Development, for the biennium beginning July 1, 2007, out of the General Fund, the following amounts
for the following purposes:

SECTION 25. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 3 (1), chapter 789, Oregon Laws 2005, as modified by Emergency Board
action, for the biennium ending June 30, 2007, as the maximum limit for payment
of expenses from fees, moneys or other revenues, including Miscellaneous
Receipts, but excluding lottery funds and federal funds, collected or received
by the Department of Education, is increased by $100,000.
SECTION 25a. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Department of Education by section 2 (10), chapter 699, Oregon Laws 2007
(Enrolled House Bill 5019), for the biennium beginning July 1, 2007, is
increased by $160,000 for civics education.
SECTION 25b. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Department of Education by section 1 (1), chapter 699, Oregon Laws 2007
(Enrolled House Bill 5019), for the biennium beginning July 1, 2007, is
increased by $300,000 for a study on transportation costs.
SECTION 26. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Department of Veterans’ Affairs by section 1 (2), chapter 138, Oregon Laws 2007
(Enrolled Senate Bill 5541), for the biennium beginning July 1, 2007, is
increased by $29,600.
SECTION 27. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 1 (1), chapter 78, Oregon Laws 2007 (Enrolled Senate Bill 5524), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Oregon Liquor Control Commission, is increased by $1,278,000.
SECTION 28. (1)
Notwithstanding any other law limiting expenditures, the limitation on
expenditures established by section 2 (5), chapter 439, Oregon Laws 2007
(Enrolled Senate Bill 5533), for the biennium beginning July 1, 2007, as the
maximum limit for payment of expenses from fees, moneys or other revenues,
including Miscellaneous Receipts, but excluding lottery funds and federal
funds, collected or received by the Department of State Police for the Oregon
Wireless Interoperability Network, is decreased by $3,679,588.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2 (4), chapter 439, Oregon Laws 2007 (Enrolled Senate Bill 5533), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Department of State Police is increased by $449,999 for a web-based incident
reporting system for the Office of the State Fire Marshal.
SECTION 29. Notwithstanding
any other provision of law, the appropriation out of the General Fund for the
Department of State Police established by section 1 (1), chapter 718, Oregon
Laws 2005, for the biennium ending June 30, 2007, is decreased by $661,658.
SECTION 30. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Department of State Police by section 1 (1), chapter 439, Oregon Laws 2007
(Enrolled Senate Bill 5533), for the biennium beginning July 1, 2007, is
increased by $661,658.
SECTION 31. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2, chapter 728, Oregon Laws 2007 (Enrolled Senate Bill 5520), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Department of Justice is increased by $2,215,294 for activities related to
juvenile dependency issues.
SECTION 32. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Department of Justice by section 1, chapter 728, Oregon Laws 2007
(Enrolled Senate Bill 5520), for the biennium beginning July 1, 2007, is
increased by $925,485.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2, chapter 728, Oregon Laws 2007 (Enrolled Senate Bill 5520), for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the
Department of Justice is decreased by $925,485.
SECTION 33. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2, chapter 728, Oregon Laws 2007 (Enrolled Senate Bill 5520), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Department of Justice is increased by $2,219,482 for costs associated with
processing and reviewing claims received under the provisions of ORS 197.352
(Ballot Measure 37 (2004)).
SECTION 33a. Notwithstanding
any other provision of law, the General Fund appropriation made to the
Department of Corrections by section 1 (1), chapter 594, Oregon Laws 2007
(Enrolled Senate Bill 5505), for the biennium beginning July 1, 2007, is
decreased by $1,000,000.
SECTION 34. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Public Defense Services Commission by section 1 (1), chapter 596, Oregon
Laws 2007 (Enrolled Senate Bill 5535), for the biennium beginning July 1, 2007,
is increased by $958,926 to establish a juvenile dependency appeals section.
(2) Notwithstanding any
other provision of law, the General Fund appropriation made to the Public
Defense Services Commission by section 1 (2), chapter 596, Oregon Laws 2007
(Enrolled Senate Bill 5535), for the biennium beginning July 1, 2007, is
increased by $991,074 to increase compensation for public defense services
providers.
SECTION 35. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2 (5), chapter 747, Oregon Laws 2007 (Enrolled House Bill 5037), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and certain federal funds, collected or received by
the Oregon Military Department is increased by $6,303,131 for payments to local
jurisdictions for operation of local 9-1-1 centers.
SECTION 35a. (1)
Notwithstanding any other provision of law, the General Fund appropriation made
to the Oregon Military Department by section 1 (5), chapter 747, Oregon Laws
2007 (Enrolled House Bill 5037), for the biennium beginning July 1, 2007, is
increased by $94,600.
(2) Notwithstanding any
other law limiting expenditures, the limitation on expenditures established by
section 2 (5), chapter 747, Oregon Laws 2007 (Enrolled House Bill 5037), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Oregon Military Department, is increased by $94,600.
SECTION 35b. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Oregon Military Department, for the biennium beginning July 1, 2007, out
of the General Fund, the amount of $500,000, which may be expended for costs
associated with the Oregon Military Emergency Financial Assistance Fund
established by ORS 396.364.
SECTION 36. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Judicial Department, for the biennium beginning July 1, 2007, out of the
General Fund, the amount of $700,000, which may be expended for a one-time
grant to the Oregon State Bar for legal aid services.
SECTION 36a. Notwithstanding any other provision of law,
the General Fund appropriation made to the Judicial Department by section 1
(1), chapter 758, Oregon Laws 2007 (Enrolled Senate Bill 5518), for the
biennium beginning July 1, 2007, is increased by $955,105.
SECTION 37. In
addition to and not in lieu of any other appropriation, there are appropriated
to the Legislative Administration Committee for the biennium beginning July 1,
2007, out of the General Fund, the following amounts for the following
purposes:
(1) Costs associated with debt
service for the
Capitol
renovation project............................ $ 3,999,943
(2) Other costs associated with
the Capitol
renovation
project, including
but not
limited to relocation
costs................. $ 1,106,869
SECTION 37a. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 2, chapter 762, Oregon Laws 2007 (Enrolled Senate Bill 5522), for
the biennium beginning July 1, 2007, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including Miscellaneous Receipts,
but excluding lottery funds and federal funds, collected or received by the
Legislative Administration Committee, is increased by $770,000.
SECTION 38. (1)
Notwithstanding any other law limiting expenditures, the amount of $1 is
established for the biennium beginning July 1, 2007, as the maximum
limit for payment of expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds and federal funds,
collected or received by the State Treasurer for relocation costs of state
treasury operations resulting from the Capitol renovation project.
(2) Notwithstanding any
other law limiting expenditures, the amount of $1 is established for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the State
Treasurer for relocation costs of the Oregon 529 College Savings Network
resulting from the Capitol renovation project.
NOTE:
Section 39 was deleted by amendment. Subsequent sections were not renumbered.
SECTION 40. Notwithstanding
any other law limiting expenditures, the limitation on expenditures established
by section 4, chapter 736, Oregon Laws 2007 (Enrolled House Bill 5026), for the
biennium beginning July 1, 2007, as the maximum limit for payment of expenses
from fees, moneys or other revenues, including Miscellaneous Receipts, but
excluding lottery funds and federal funds, collected or received by the Office
of the Governor, is increased by $200,000 for the purpose of funding the
education design team.
SECTION 41. Notwithstanding
any other provision of law, the authorized appropriations and expenditure
limitations for the biennium beginning July 1, 2007, for the following agencies

2007 Act being necessary for the immediate preservation of the public peace,
health and safety, an emergency is declared to exist, and this 2007 Act takes
effect on its passage.
