  Creates crime of obstructing an audit. Punishes by maximum of
five years' imprisonment, $125,000 fine, or both.
 
                        A BILL FOR AN ACT
Relating to audits.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + A person commits the crime of obstructing an
audit if the person:
  (1) Is an employee of a state agency as defined in ORS 297.110;
and
  (2) During an audit conducted pursuant to ORS 297.210 or an
investigation conducted pursuant to ORS 177.180 or 297.120:
  (a) Intentionally makes a false material statement or provides
false or misleading material information to the Secretary of
State or a person conducting an audit or investigation on behalf
of the Secretary of State;
  (b) Intentionally withholds material information; or
  (c) Directs another person not to cooperate with the audit or
investigation, or otherwise prevents or attempts to prevent
another person from cooperating. + }
  SECTION 2.  { + Violation of section 1 of this 2007 Act is a
Class C felony. + }
