  On page 1 of the printed bill, line 3, after '469.205 ' insert
', 469.206'.
  On page 4, line 42, after 'energy' delete the rest of the line
and line 43 and insert 'through use of both energy efficiency and
on-site renewable energy resources; and'.
  On page 7, after line 41, insert:
  '  { +  SECTION 5a. + } ORS 469.206 is amended to read:
  ' 469.206. (1) The owner of a facility may transfer a tax
credit for the facility in exchange for a cash payment equal to
the present value of the tax credit.
  ' (2) The State Department of Energy may establish by rule
uniform discount rates to be used in calculating the present
value of a tax credit under this section.
  '  { +  (3) Notwithstanding any other provision of law, a tax
credit transferred pursuant to this section does not decrease the
amount of taxes required to be reported by a public utility. + }
' .
  On page 9, line 12, after '469.205' insert ', 469.206 ' and
delete 'cer-' and insert 'acquired, erected, constructed or
installed on or after January 1, 2007,'.
  In line 13, delete 'tified on or after the effective date of
this 2007 Act'.
