                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Directs school districts to expend at least 65 percent of
operational expenditures on classroom instruction expenditures.
Allows school districts to phase in expenditure requirement.
Allows Superintendent of Public Instruction to grant waiver of
requirement.
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to school districts; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + As used in this section and sections 2 and 3 of
this 2007 Act:
  (1) 'Classroom instruction expenditures' means expenditures
directly related to classroom instruction, including but not
limited to expenditures for:
  (a) Teacher and instructional staff salaries and benefits;
  (b) Textbooks and other instructional materials;
  (c) Classroom computers;
  (d) General instructional supplies; and
  (e) Libraries and librarians.
  (2) 'Instruction' includes, but is not limited to:
  (a) Activities that are directly related to the interaction
between students and teachers or instructional staff;
  (b) Special education;
  (c) English as a second language instruction;
  (d) Instruction provided by tutors; and
  (e) Class activities, including but not limited to field trips,
physical education, music, the arts and multidisciplinary
learning.
  (3) 'Operational expenditures' means all expenditures a school
district makes, except for:
  (a) Capital construction;
  (b) Debt or bond payments; and
  (c) Facility rent or lease payments. + }
  SECTION 2.  { + Each fiscal year, a school district shall
expend at least 65 percent of the school district's operational
expenditures on classroom instruction expenditures. + }
  SECTION 3.  { + (1) Notwithstanding section 2 of this 2007 Act,
if a school district does not meet the requirements of section 2
of this 2007 Act for the fiscal year beginning July 1, 2007, the
school district shall increase the school district's classroom
instruction expenditures by two percent or more of the school
district's operational expenditures each fiscal year until the
school district meets the requirements of section 2 of this 2007
Act.
  (2) A school district may request from the Superintendent of
Public Instruction a one-year waiver of the requirements of
subsection (1) of this section and section 2 of this 2007 Act.
  (3) The superintendent shall grant or deny a school district
waiver request within 45 days of receipt of the request. The
superintendent may grant a portion of a waiver request. The
superintendent may renew a waiver upon request from a school
district. + }
  SECTION 4.  { + Section 2 of this 2007 Act applies to fiscal
years beginning on or after July 1, 2007. + }
  SECTION 5.  { + This 2007 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2007 Act takes effect on its
passage. + }
