                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
 
  Makes livestock district and open range laws inapplicable to
some bovine animals.
  Provides that landowner is not required to fence against hogs
or bison to make owner or possessor of hogs or bison liable for
damage by trespassing animal.
  Prohibits allowing bison to run on property of another. Makes
violation punishable by maximum of $90 fine.
 
                        A BILL FOR AN ACT
Relating to livestock; creating new provisions; and amending ORS
  607.005, 608.510 and 608.990.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 607.005 is amended to read:
  607.005. As used in this chapter:
  (1) 'Class of livestock' means a class, species, genus or sex
of livestock, including a class, species or genus of neutered
livestock.
  (2) 'Department' means the State Department of Agriculture.
  (3) 'Federal land' means a tract of land containing 25,000
acres or more owned or administered by, or under the jurisdiction
of, the United States and not subject to the laws of this state.
  (4) 'Livestock' means   { - animals of the bovine species - }
 { +  cattle + }, horses, mules, asses, sheep, goats and swine.
  (5) 'Livestock district' means an area wherein it is unlawful
for livestock or a class of livestock to run at large.
  (6) 'Open range' means an area wherein livestock may lawfully
be permitted to run at large.
  SECTION 2. ORS 608.510 is amended to read:
  608.510.  { + (1) Notwithstanding ORS 608.015, + } the owner or
occupant of   { - premises - }  { +  a property + } is not
required to fence against  { +  trespass by + } hogs { +  or
bison in order to hold the owner or lawful possessor of the hogs
or bison liable for damage done by the animals + }.

entitled to the possession of a hog   { - shall permit it - }
 { +  or bison may not permit the hog or bison + } to run at
large or upon the property of another person.
  SECTION 3. ORS 608.990 is amended to read:
  608.990. (1) Violation of ORS 608.330 is punishable, upon
conviction, by a fine not exceeding $50 or by imprisonment in the
county jail not exceeding 10 days, or both.
  (2) Violation of ORS 608.380 is a Class A violation.
  (3) Violation of ORS 608.510 { +  (2) + } is a Class D
violation.
  SECTION 4.  { + The amendments to ORS 608.510 and 608.990 by
sections 2 and 3 of this 2007 Act apply to hogs and bison
trespassing or running at large upon the property of another on
or after the effective date of this 2007 Act. + }
