SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Establishes Manufactured Structure Relocation Fund separate and
distinct from General Fund. Continuously appropriates moneys in
fund to Housing and Community Services Department for use in
providing financial assistance to manufactured structure owners
receiving notice of termination of tenancy due to manufactured
dwelling park closure. Makes appropriation from General Fund to
provide financial resource for continuing use by Manufactured
Structure Relocation Fund.
Declares emergency, effective July 1, 2007.
A BILL FOR AN ACT
Relating to financial assistance to manufactured structure
owners; appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + The Manufactured Structure Relocation Fund is
established in the State Treasury, separate and distinct from the
General Fund. The Manufactured Structure Relocation Fund shall
consist of all moneys received as repayment of principal,
interest, fees, charges or other proceeds on loans made from the
fund and any moneys otherwise deposited to the fund. Interest
earned by the Manufactured Structure Relocation Fund shall be
credited to the fund. Moneys in the fund are continuously
appropriated to the Housing and Community Services Department for
the purpose of administering the loan and grant programs
described in section 2 of this 2007 Act. + }
SECTION 2. { + (1) As used in this section, 'federal poverty
guidelines' means the United States Department of Health and
Human Services poverty guidelines set forth in the 2006 Federal
Register, or a later edition of those guidelines adopted by the
Director of the Housing and Community Services Department by
rule.
(2) Subject to subsections (3) and (4) of this section, the
Housing and Community Services Department may use the
Manufactured Structure Relocation Fund to advance moneys by
contract, loan, grant or otherwise for the purpose of providing
financial assistance to manufactured structure owners who receive
a notice of termination of tenancy under ORS 90.630 (5).
(3) The department may use up to 80 percent of the moneys
deposited to the fund for the purpose of making low-interest
loans available to manufactured structure owners described in
subsection (2) of this section. The department may make the loans
directly or through the use of intermediary financial
institutions. The total of fund moneys loaned to a single
household under this section may not exceed $10,000. In making
loans that include fund moneys the department and financial
institutions shall give preference to borrowers applying the loan
proceeds toward the payment of manufactured structure moving and
set-up costs, as defined by the department by rule.
Notwithstanding subsection (4) of this section, moneys deposited
to the fund to repay the principal of loans made under this
subsection shall be used for making additional loans under this
subsection.
(4) The department may use up to 20 percent of the moneys
deposited to the fund for grants to manufactured structure owners
described in subsection (2) of this section who have a household
income level that does not exceed the federal poverty guidelines.
The total of all grants under this section to a single household
may not exceed $10,000. In making grants of fund moneys the
department shall give preference to manufactured structure owners
applying the grant toward the payment of manufactured structure
moving and set-up costs, as defined by the department by rule.
(5) Notwithstanding subsections (3) and (4) of this section,
the department may use moneys received by the fund as interest
payment on loans made under subsection (3) of this section for
the purpose of paying the administrative expenses of the
department in carrying out the loan and grant programs described
in this section. Moneys received as interest payment on loans and
not used to pay administrative expenses under this subsection
shall be used for the purposes described in subsection (2) of
this section. + }
SECTION 3. { + (1) In addition to and not in lieu of any other
appropriation, there is appropriated to the Manufactured
Structure Relocation Fund created in section 1 of this 2007 Act
out of the General Fund, the amount of $10,000,000 which may be
expended by the Housing and Community Services Department for the
purpose of carrying out the provisions of section 2 of this 2007
Act.
(2) The purpose of the appropriation made under this section is
to permanently transfer moneys to the Manufactured Structure
Relocation Fund to provide the initial financial resources for
the fund. Moneys appropriated under this section and deposited to
the Manufactured Structure Relocation Fund are available
continuously for use as Manufactured Structure Relocation Fund
moneys. The Manufactured Structure Relocation Fund is not
required to repay the General Fund for any moneys appropriated
under this section. Notwithstanding ORS 293.190, any moneys in
the Manufactured Structure Relocation Fund that remain unexpended
on December 31, 2009, shall be retained in the Manufactured
Structure Relocation Fund for future use instead of reverting to
the General Fund.
(3) The department may expend up to five percent of the moneys
appropriated under this section for the purpose of developing and
administering the program described in section 2 of this 2007
Act. + }
SECTION 4. { + This 2007 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2007 Act takes effect July 1,
2007. + }
