fictitious or fraudulent statement in affidavit or declaration of
lawful presence commits crime of perjury. Punishes each separate
violation by maximum of five years' imprisonment, $125,000 fine,

Department of Human Services to collect data and report to
appropriate interim legislative committee regarding citizenship
or legal residence requirements for Department of Human Services

A BILL FOR AN ACT
Relating to verification of lawful presence in United States for
applicants for assistance.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Oregon Department of Administrative
Services and the Department of Human Services are directed to
work together to collect data and prepare a report on the
citizenship or legal residence requirements, if any, for
assistance provided by programs that the Department of Human
Services operates, or contracts with entities to operate, and
shall present the report to an appropriate interim legislative
committee no later than July 1, 2008.
(2) The report described in subsection (1) of this section
shall include, but is not limited to, the following information:
(a) The type of assistance provided by the Department of Human
Services or entities with which the department contracts; and
(b)(A) Whether citizenship or legal residence in the United
States is required to obtain the assistance;
(B) If citizenship or legal residence is required to obtain
assistance, the proof of citizenship or legal residence that is
required for each type of assistance; and
(C) Whether there are state or federal requirements for
citizenship or legal residence and if so, what the requirements
are.
(3) As used in this section, 'assistance' means public
assistance as defined in ORS 411.010, benefits and services for
persons with disabilities, publicly funded or
government-subsidized housing, food or nutrition programs and
unemployment insurance benefits. + }
