'; and declaring an emergency'.
Delete lines 4 through 30 and delete page 2 and insert:
' { + SECTION 1. + } { + (1) There is created the Task Force
on Establishing a Mental Health Database, consisting of 13
members appointed as follows:
' (a) The President of the Senate shall appoint two members
from among members of the Senate.
' (b) The Speaker of the House of Representatives shall appoint
two members from among members of the House of Representatives.
' (c) The Governor shall appoint the following nine members:
' (A) One member from the Department of State Police;
' (B) One member from the Department of Human Services;
' (C) One member from the Oregon State Sheriffs' Association;
' (D) One member from the Oregon Association Chiefs of Police;
and
' (E) Five members who have a demonstrated interest in
facilitating law enforcement interaction with mentally ill
persons. These members may be selected from state and local
agencies, advocacy groups for the mentally ill, mental health
clients and their families and caregivers, and the medical
community.
' (2)(a) In appointing the members of the task force, the chief
sponsors of this 2007 Act shall be consulted:
' (A) By the President of the Senate and the Speaker of the
House of Representatives, as applicable, to determine the chief
sponsors' interest in participating as members of the task force;
and
' (B) By the Governor to assist in identifying task force
members.
' (b) The appointing authorities shall appoint members of the
task force that represent a diverse array of communities in terms
of size and geographic location.
' (3) The task force shall identify issues, explore solutions
and make recommendations the Seventy-fifth Legislative Assembly
regarding the establishment and implementation of a Mental Health
Database to aid law enforcement officers in assisting mentally
ill individuals to obtain medical, mental health and social
services.
' (4) A majority of the members of the task force constitutes a
quorum for the transaction of business.
' (5) Official action by the task force requires the approval
of a majority of the members of the task force.
' (6) The task force shall elect one of its members to serve as
chairperson.
' (7) If there is a vacancy for any cause, the appointing
authority shall make an appointment to become immediately
effective.
' (8) The task force shall meet at times and places specified
by the call of the chairperson or a majority of the members of
the task force.
' (9) The task force may adopt rules necessary for the
operation of the task force.
' (10) The task force shall submit a report, and may include
recommendations for legislation, to the appropriate interim
legislative committee with oversight of the judiciary or, if no
such interim legislative committee is created, to the Speaker of
the House of Representatives and the President of the Senate, no
later than October 1, 2008.
' (11) Notwithstanding ORS 171.072, members of the task force
who are members of the Legislative Assembly are not entitled to
mileage expenses or a per diem and serve as volunteers on the
task force. Other members of the task force are not entitled to
compensation or reimbursement for expenses and serve as
volunteers on the task force.
' (12) All agencies of state government, as defined in ORS
174.111, are directed to assist the task force in the performance
of its duties and, to the extent permitted by laws relating to
confidentiality, to furnish such information and advice as the
members of the task force consider necessary to perform their
duties. + }
' { + SECTION 2. + } { + Section 1 of this 2007 Act is
repealed on January 2, 2009. + }
' { + SECTION 3. + } { + This 2007 Act being necessary for
the immediate preservation of the public peace, health and
safety, an emergency is declared to exist, and this 2007 Act
takes effect on its passage. + } ' .
