SUMMARY

Provides opportunity for counties to reacquire certain
forestlands previously acquired by State Board of Forestry from
counties without consideration other than statutory revenue
sharing.
A BILL FOR AN ACT
Relating to intergovernmental forestland transfer.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) A county may reacquire lands previously
acquired under ORS 530.030 by the State Board of Forestry from
counties without consideration other than the payments
contemplated by ORS 530.110 if the governing body of the county
adopts a resolution requesting reconveyance and:
(a) The board determines that the county has a county forest
management program capable of providing appropriate management
for the lands;
(b) The county reimburses the board for what the board
determines to be an appropriate percentage of the costs incurred
relating to bonds issued in relation to the management of the
land; and
(c) The county covenants to set aside and manage the lands as
county forests under ORS 275.330.
(2) Subsection (1) of this section reflects the legislative
intent to bind counties to a statutory contract. Reacquisition of
lands by a county under this section binds the county to manage
lands reacquired under this section as county forests under ORS
275.330. + }
