                             AN ACT
 
 
Relating to financial administration of the Department of
  Justice; appropriating money; and declaring an emergency.
 
Be It Enacted by the People of the State of Oregon:
 
  SECTION 1.  { + There is appropriated to the Department of
Justice, for the biennium beginning July 1, 2007, out of the
General Fund, the amount of $9,855,420 to be expended for:
  (1) Paying expenses of district attorneys, as provided in
section 2 of this 2007 Act;
  (2) Special payments to counties for costs of prosecution,
including but not limited to costs of deputy district attorneys
as provided in section 3 of this 2007 Act and witness fees; and
  (3) Paying the expenses incurred in administering sections 1 to
4 of this 2007 Act, as provided in section 4 of this 2007
Act. + }
  SECTION 2.  { + The Department of Justice, for the biennium
beginning July 1, 2007, may allocate moneys from the
appropriation made by section 1 of this 2007 Act for the payment
of expenses of district attorneys. + }
  SECTION 3.  { + (1) The Department of Justice, for the biennium
beginning July 1, 2007, may allocate moneys from the
appropriation made by section 1 of this 2007 Act for special
payments to counties for costs of prosecution. The amount of the
payment to each county shall be determined on the basis of the
number of eligible district attorney positions in the county.
  (2) Eligible deputy district attorney positions for which
counties may claim payment under this section are those filled by
incumbents on the first day of the fiscal year, the salaries for
which are not paid entirely from federal funds. Each county shall
certify to the Department of Justice, not later than the 30th day
of the fiscal year, the number of eligible deputy district
attorney positions.
  (3) Beginning July 1, 2007, from the allocation made by
subsection (1) of this section, each county shall receive
annually the amount of $1,250 per eligible deputy district
attorney position for up to the first three deputy district
attorney positions certified by a county under subsection (2) of
this section and the amount of $1,250 for the position of
district attorney. The remainder of the allocation made by
subsection (1) of this section shall be paid in annual
installments, in each year of the biennium, to the various

counties in direct proportion to the number of eligible deputy
district attorney positions certified under subsection (2) of
this section, reduced by the number of eligible deputy district
attorney positions for which payments are made under this
subsection. + }
  SECTION 4.  { + The Department of Justice, for the biennium
beginning July 1, 2007, may allocate moneys from the
appropriation made by section 1 of this 2007 Act for the payment
of expenses incurred in administering sections 1 to 4 of this
2007 Act. + }
  SECTION 5.  { + This 2007 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2007 Act takes effect July 1,
2007. + }
