                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Urges Congress to increase federal funding for purpose of more
fully reimbursing states and schools districts for costs of
educating children with disabilities.
 
                         JOINT MEMORIAL
To the President of the United States and the Senate and the
  House of Representatives of the United States of America, in
  Congress assembled:
  We, your memorialists, the Seventy-fourth Legislative Assembly
of the State of Oregon, in legislative session assembled,
respectfully represent as follows:
  Whereas the Individuals with Disabilities Education Act (20
U.S.C. 1400 et seq.) requires states to provide a free and
appropriate public education to children with disabilities; and
  Whereas children with disabilities deserve an equal educational
opportunity; and
  Whereas providing special education and related services to
children with disabilities is expensive and is a major
contributor to increased education costs at the state and local
levels; and
  Whereas the Individuals with Disabilities Education Act
authorizes appropriations for the purpose of making grants to
assist states with the expenses of providing special education
and related services to children with disabilities in accordance
with federal law; and
  Whereas the Individuals with Disabilities Education Act
authorizes the Congress of the United States to appropriate funds
to pay for up to 40 percent of the average per pupil expenditure
involved in educating children with disabilities; and
  Whereas the Congress of the United States has not appropriated
the maximum amount of funds allowable under the Individuals with
Disabilities Education Act; now, therefore,
Be It Resolved by the Legislative Assembly of the State of
  Oregon:
  (1) The Congress of the United States is respectfully urged to
appropriate additional funds up to the maximum allowable amount
under the Individuals with Disabilities Education Act for the
purpose of more fully reimbursing states and school districts
 
that are providing the important service of educating children
with disabilities as required by federal law.
  (2) A copy of this memorial shall be sent to the President of
the United States and to each member of the Oregon Congressional
Delegation.
