To Secretary of Education Margaret Spellings and the United
  States Department of Education:
  We, your memorialists, the Seventy-fourth Legislative Assembly
of the State of Oregon, in legislative session assembled,
respectfully represent as follows:
  Whereas Oregon's Superintendent of Public Instruction and her
designees have been in contact with the United States Department
of Education and your office regarding the disruption of Oregon's
state assessments; and
  Whereas this disruption in assessment testing was not due to
any action taken by Oregon's public schools or any of the more
than 560,000 schoolchildren in our state; now, therefore,
 
Be It Resolved by the Legislative Assembly of the State of
  Oregon:
 
  (1) Secretary of Education Margaret Spellings and the United
States Department of Education are respectfully requested to work
with Oregon when determining adequate yearly progress for the
state, its local education agencies and its schools for the
2006-2007 school year if Oregon experiences a drop in assessment
scores or participation rates to a level that statistically
suggests that the disruption was caused by the discontinuation of
service by the assessment contractor.
  (2) A copy of this memorial shall be sent to Secretary of
Education Margaret Spellings and the United States Department of
Education.
