                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Directs Department of Environmental Quality to conduct Oregon
Curbside Recycling Pilot Program and report to Legislative
Assembly by July 1, 2009.
  Appropriates moneys from General Fund to department to pay
costs of assessment.
  Sunsets January 2, 2010.
 
                        A BILL FOR AN ACT
Relating to curbside recycling; and appropriating money.
  Whereas Oregon has a long tradition of pioneering innovative
recycling programs; and
  Whereas recycling saves energy, which in turn reduces the
United States' dependence on foreign oil and reduces pollution
associated with energy production; and
  Whereas recycling reduces the need to extract certain natural
resources; and
  Whereas recycling can create more jobs than disposing of solid
waste through incineration or in landfills; and
  Whereas recycling can have a lower cost for communities than
other waste disposal options; and
  Whereas recycling supplies valuable raw materials to Oregon
industries; and
  Whereas recycling stimulates the development of environmentally
sound technologies; and
  Whereas recycling reduces Oregon's need for new landfills and
incinerators; and
  Whereas many new markets for recycling have been created during
the past decade, including remanufacturing plastic containers
into other goods; and
  Whereas despite the growth in markets for recycled materials,
curbside recycling programs have become stagnant, with recycling
rates for plastic and aluminum containers remaining constant or
decreasing; and
  Whereas Oregon has fallen below the statutory requirement for
recycling rigid plastic containers; and
  Whereas local, state and federal governments should encourage
increased curbside recycling of recyclable household products;
and
  Whereas there remains a significant opportunity to increase
recycling in Oregon, and the citizens of Oregon should be
encouraged to participate in educational, organizational and
legislative endeavors that promote curbside recycling; now,
therefore,
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + The Department of Environmental Quality shall
establish a statewide curbside recycling pilot program. This
program shall be known as the Oregon Curbside Recycling Pilot
Program. The purpose of this program is to:
  (1) Lower Oregon's dependence on virgin packaging materials;
  (2) Increase the rate of household materials recycled in
Oregon, including plastics, fiber and aluminum and other metals;
  (3) Create a self-sustaining curbside recycling model that may
be used in all communities in Oregon;
  (4) Create a model that financially rewards consumer recycling
stewardship;
  (5) Reduce health and safety risks associated with Oregon's
beverage container redemption laws; and
  (6) Reduce litter and illegal dumping of household packaging
and other materials. + }
  SECTION 2.  { + The Oregon Curbside Recycling Pilot Program
shall:
  (1) Include a minimum of 20,000 households with curbside
recycling service;
  (2) Coordinate with existing local companies that transport
solid waste;
  (3) Provide a single recycling container to participating
households;
  (4) Include households in the following regions:
  (a) Oregon's coast;
  (b) Central Oregon;
  (c) Eastern Oregon; and
  (d) The Portland metropolitan region;
  (5) Provide assistance to retrofit recycling equipment, if
necessary to participate in the program;
  (6) Work in partnership with Stop Oregon Litter and Vandalism
and RecycleBank, Inc. to establish the program; and
  (7) Consider ways to fund local litter control and cleanup
efforts. + }
  SECTION 3.  { + (1) The Director of the Department of
Environmental Quality shall establish an Oregon Curbside
Recycling Pilot Program Advisory Board to advise the Department
of Environmental Quality on matters related to the pilot program.
The board shall consist of 11 members comprised of:
  (a) One member from each of the following regions:
  (A) Oregon's coast;
  (B) Central Oregon;
  (C) Eastern Oregon; and
  (D) The Portland metropolitan region;
  (b) One member from each of the following organizations:
  (A) Stop Oregon Litter and Vandalism; and
  (B) RecycleBank, Inc.;
  (c) One member who represents Oregon's grocery and retail
outlets;
  (d) One member who represents Oregon's recycling industry;
  (e) One member appointed by the President of the Senate;
  (f) One member appointed by the Speaker of the House of
Representatives; and
  (g) One member appointed by the Governor.
  (2) The advisory board shall submit a report, and may include
recommendations for legislation, to the interim legislative
committees on the environment and natural resources by October 1,
2008. + }
  SECTION 4.  { + The Department of Environmental Quality shall
complete the Oregon Curbside Recycling Pilot Program established
in section 1 of this 2007 Act by July 1, 2009. + }
  SECTION 5.  { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of
Environmental Quality, for the biennium beginning July 1, 2007,
out of the General Fund, the amount of $___ to pay the costs of
the Oregon Curbside Recycling Pilot Program established in
section 1 of this 2007 Act. + }
  SECTION 6.  { + Sections 1 to 4 of this 2007 Act are repealed
on January 2, 2010. + }
