of fleeing or attempting to elude police officer under certain
circumstances.
A BILL FOR AN ACT
Relating to sentencing guidelines.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + The Oregon Criminal Justice Commission shall
classify fleeing or attempting to elude a police officer as
described in ORS 811.540 (1)(b)(A):
(1) As a person felony and crime category 6 of the sentencing
guidelines grid of the commission if the person:
(a) Is operating the vehicle at more than 20 miles per hour
above the posted speed limit; or
(b) Has one or more prior convictions under ORS 811.540
(1)(b)(A).
(2) As a person felony and crime category 8 of the sentencing
guidelines grid of the commission if both conditions in
subsection (1) of this section apply. + }
