SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Increases membership of Emergency Board. Provides that board
consists of 10 members of House of Representatives and 10 members
of Senate. Provides that quorum of Emergency Board is majority of
House members and majority of Senate members. Requires
affirmative vote of majority of House members and of majority of
Senate members for action by Emergency Board.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to the Emergency Board; amending ORS 291.330 and
291.332; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 291.330 is amended to read:
291.330. The Emergency Board shall be composed of the President
of the Senate, the Speaker of the House of Representatives, the
chairpersons of the Senate and House Ways and Means Committees,
{ - six - } { + eight other + } members of the Senate, at
least { - three - } { + four + } of whom shall have had some
previous experience on the Ways and Means Committee, to be
appointed by the President of the Senate and confirmed by a
majority of all the members elected to the Senate, and
{ - seven - } { + eight other + }members of the House, at
least four of whom shall have had some previous experience on the
Ways and Means Committee, to be appointed by the Speaker and
confirmed by a majority of all the members elected to the House.
SECTION 2. ORS 291.332 is amended to read:
291.332. (1) The Emergency Board shall meet immediately upon
adjournment of each Legislative Assembly and elect a chairperson
from their number. The board shall meet thereafter at such times
as it may determine.
{ + (2) The board may not transact business unless a quorum
is present. A quorum consists of a majority of board members from
the House of Representatives and a majority of board members from
the Senate.
(3) Action by the board requires the affirmative vote of a
majority of board members from the House of Representatives and a
majority of board members from the Senate. + }
{ - (2) - } { + (4) + } The term of members of the board
shall run from the adjournment of one regular session to the
organization of the next regular session.
{ - (3) - } { + (5) + } If a vacancy occurs in the board,
either the Speaker, if the legislator previously filling the
position was a member of the House, or the President, if the
legislator previously filling the position was a member of the
Senate, shall fill such vacancy by an appointment for the
unexpired term. However, such appointment, before becoming
effective, shall be confirmed by the remaining members of the
board, sitting as such board.
SECTION 3. { + This 2007 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2007 Act takes effect on its
passage. + }
