brief statement of the essential features of the measure as
introduced.
Directs Office of Emergency Management to develop and operate
statewide first responder building mapping information system.
A BILL FOR AN ACT
Relating to first responder building mapping information systems;
creating new provisions; and amending ORS 401.270.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Sections 2 and 3 of this 2007 Act are added to
and made a part of ORS 401.260 to 401.325. + }
SECTION 2. { + (1) As used in this section and section 3 of
this 2007 Act:
(a) 'First responder' means an individual who, as a regular
function of the individual's employment or in a voluntary
capacity as an emergency service worker, provides initial
response to the scene of an emergency.
(b) 'School building' means a building used by a school
district to provide educational services.
(c) 'School district' means a school district as that term is
defined in ORS 332.002 or a public charter school as that term is
defined in ORS 338.005.
(2) The Office of Emergency Management shall, as authorized in
ORS 401.280, seek moneys to create and implement a statewide
first responder building mapping information system, including
moneys for grants to state agencies, local governments and school
districts to cover the costs of mapping buildings.
(3) The office, in consultation with the State Fire Marshal,
the Department of State Police and emergency service agencies as
defined in ORS 401.025, shall develop guidelines for and create a
statewide first responder building mapping information system. In
developing the guidelines the office shall consider:
(a) The type of information to be included in the statewide
first responder building mapping information system including,
but not limited to, building floor plans, fire protection
information, evacuation plans, utility information, known hazards
and text and digital images showing emergency personnel contact
information;
(b) Standards for building mapping software to be used by
entities participating in the statewide first responder building
mapping information system;
(c) The order in which buildings are mapped;
(d) The method for making the information in the statewide
first responder building mapping information system available
including, but not limited to, detailed procedures and security
systems to ensure that the information is made available only to
the entity that owns the building or to a first responder
responding to an emergency at the building; and
(e) Training guidelines for use of the statewide first
responder building mapping information system by first
responders, emergency service agencies and other providers of
emergency services. + }
SECTION 3. { + (1) The Office of Emergency Management shall
operate the statewide first responder building mapping
information system created under section 2 of this 2007 Act.
(2) State agencies, local governments and school districts
shall utilize building mapping software that complies with the
standards for building mapping software that are developed under
section 2 of this 2007 Act for all buildings mapped.
(3) If, prior to the date when the statewide first responder
building mapping information system becomes operational, a state
agency, local government or school district has utilized building
mapping software that is compatible with the standards developed
under section 2 of this 2007 Act, the state agency, local
government or school district may continue to use its own
building mapping software unless the office provides funds to
bring the state agency, local government or school district's
building mapping software in full compliance with the standards
developed under section 2 of this 2007 Act.
(4) When sufficient moneys are available to the office:
(a) The office shall make grants available to state agencies,
local governments and school districts to cover the costs of
mapping buildings; and
(b) A state agency, a local government or a school district
that is provided with grant funding by the office shall map all
buildings that:
(A) Are owned by a state or local government and are occupied
by state or local government employees.
(B) School buildings.
(5) Indian tribes or tribal organizations, federal government
agencies and private persons that own buildings in this state may
participate in the statewide first responder building mapping
information system. The office shall adopt rules pertaining to
the participation.
(6) After the statewide first responder building mapping
information system is operational:
(a) State agencies, local governments and school districts that
have mapped buildings shall forward the building mapping
information to the office.
(b) Participating Indian tribes or tribal organizations,
federal government agencies and private persons may voluntarily
forward the building mapping information to the office.
(c) The office may refuse building mapping information that
does not comply with the guidelines developed under section 2 of
this 2007 Act.
(7) Consistent with the guidelines developed under section 2 of
this 2007 Act, the office shall make the building mapping
information electronically available to state, local, federal and
tribal law enforcement agencies, to the Oregon Military
Department and to fire departments and districts within the State
of Oregon.
(8) The office may not disclose building mapping information
provided to the office under this section except to the entity
that owns the building and to a first responder that is
responding to an emergency at the building.
(9) Neither this section nor section 2 of this 2007 Act:
(a) Requires that a state agency, local government or school
district map any building unless the entire cost incurred to map
the building is provided by the office.
(b) Supersedes or alters the authority of state agencies, local
governments or school districts to maintain and control access to
information within their own independent building mapping
systems. + }
SECTION 4. ORS 401.270 is amended to read:
401.270. The Director of the Office of Emergency Management
shall be responsible for coordinating and facilitating emergency
planning, preparedness, response and recovery activities with the
state and local emergency services agencies and organizations,
and shall, with the approval of the Superintendent of State
Police or as directed by the Governor:
(1) Make rules that are necessary and proper for the
administration and implementation of ORS 401.015 to 401.105,
401.260 to 401.325, 401.355 to 401.580 and 401.706;
(2) Coordinate the activities of all public and private
organizations specifically related to providing emergency
services within this state;
(3) Maintain a cooperative liaison with emergency management
agencies and organizations of local governments, other states and
the federal government;
(4) Have such additional authority, duties and responsibilities
authorized by ORS 401.015 to 401.105, 401.260 to 401.325 and
401.355 to 401.580 or as may be directed by the Governor;
(5) Administer grants relating to emergency program management,
seismic rehabilitation, emergency services for the state and the
statewide 2-1-1 system as provided in ORS 401.294;
(6) Provide for and staff a State Emergency Operations Center
to aid the Governor and the Office of Emergency Management in the
performance of duties under ORS 401.015 to 401.105, 401.260 to
401.325, 401.355 to 401.580 and 401.706;
(7) Serve as the Governor's authorized representative for
coordination of certain response activities and managing the
recovery process;
(8) Establish training and professional standards for local
emergency program management personnel;
(9) Establish task forces and advisory groups to assist the
office in achieving mandated responsibilities;
(10) Enforce compliance requirements of federal and state
agencies for receiving funds and conducting designated emergency
functions;
(11) Oversee the design, implementation and support of a
statewide 2-1-1 system as provided under ORS 401.288;

(12) Coordinate the activities of state and local governments
to enable state and local governments to work together during
domestic incidents as provided in the National Incident
Management System established by the Homeland Security
Presidential Directive 5 of February 28, 2003 { + ; and
(13) Create and operate the statewide first responder building
mapping information system as provided in section 2 and 3 of this
2007 Act + }.
